The Akum Shutfis Maneno, are they
considered Oved Avodah Zarah
or are they not considered
Oved Avodah Zarah?
Avodah Zarah.
So, really the background to this just
uh
come to up to speed is the Rama
in Orech Chaim Siman Kuf Nun Vav U'vois
If Achad.
So, the Mechaber over there says that
you shouldn't be partners with an Oved
Kochavim. And the reason is because in
the context of the partnership, the Oved
Kochavim may have to swear. And if he's
going to swear, he's going to swear in
the name of his Avodah Zarah. And you
will have caused the name of an Avodah
Zarah to be mentioned, which is
something that you're not allowed to do
as it says in the Torah of Hashem
Elokeinu Lo Yisa Shav L'Shav. Lo Yisa
Shav L'Shav. Says the Rama, "The Ish
Machil B'Seer Shutfis Im Akum B'Zman
Hazeh." There are people that are meikel
nowadays Mishum She'ein Akum B'Zman
Hazeh Nishboin B'Avodah Zarah L'Alilam.
Because today the Akum don't swear
anymore in the names of Avodah Zarah.
V'Af Al Gaf De'Maskirim Kochavim
L'Avodah Zarah L'Alilam. And even though
they do mention some form of Avodah
Zarah L'Alilam, Mekum Akum She'Oim
Statein That Kavanasam L'Shem Shamayim
V'Lo L'Avodah. Their kavana really is
the creator of heaven and earth. El
Asher Shutfim Shem Shamayim V'Davar
Acher. However, what they do is they're
Meshutaf together with the creator of
heaven and earth. O'Davar Acher. V'Lo
Matzinu She'eish Shutfus Mishum Lifnei
Ivil V'Eisei De'Mishul. And you don't
find anywhere that there's an Eisei
Lifnei Ivil V'Eisei De'Mishul to cause
an Oved Kochavim to mention the name of
the Borei Shamayim V'Aretz and Avodah
Zarah. D'Arei Ein Akum Lo Avodah Zarah
Shituph. Because although an Oved Avodah
Zarah is not allowed to be an Oved
Avodah Zarah, right? A Ben Noach is not
allowed to do Avodah Zarah. It's one of
the Sheva Mitzvos. But at the same time,
they're not Muzar An Shituph. And being
that this is being done B'Shituph in
this instance, it's not going to be a
problem. And at first glance, what it
sounds like the Rama is saying is that
even though one of the seven mitzvahs of
Bnei Noach is Avodah Zarah, but at the
same time there is no issur shittuf. In
other words, a Yid is not allowed to be
over Avodah Zarah, even if it means he's
going to be over that Kodesh Baruchu and
in Avodah Zarah. Because a Yid is mussar
on shittuf. And the Makos of Mussar on
Hegech Kamma Amud Aleph, Rav Shimon ben
Yochai's memra, it says "Bilti LaShem
Levado Yizvach Lo Elohim Yochalun, Bilti
LaHavaya Levado." And from Bilti
LaHavaya Levado, we learn you're only
allowed to serve Hashem, not even
bishittuf, are you allowed to serve
Avodah Zarah? But it's the Ramah seems
to be saying that as it comes to a ben
Noach, who also has in this Avodah
Zarah, it's only to only worship Avodah
Zarah. But if he's going to worship the
Borei Shamayim Va'aretz and is going to
be meshatef with Avodah Zarah, like the
Noitzrim for example, that is not going
to be considered Avodah Zarah. Now the
Makos of Ramah's place of Simcha Bava
Basra
Tosfos in Sanhedrin Daf Samech Gimel
Amud Beis, stating that we mentioned the
Arikhos that there's a Teshuvah from the
Noda BiYehudah, which the Vilna Gaon
mistakenly refers to as a Teshuvah from
the Noda BiYehudah, not true. So one of
the 70 Teshuvos in my Yad Eliyahu that
was written by Ben Hamachaber, from the
great Gaon Rav Shmuel Landau, who said
that I believe that the Vilna Gaon is
making a Toisfos in this Ramah. The
Vilna Gaon is making a Toisfos. And that
Toisfos, the Ramah and Toisfos never
meant to say that Bnei Noach are not
mussar on shittuf. Of course they're
mussar on shittuf. But rather, the Ramah
and Toisfos were talking specifically
about the issur Shem Elohim Acheirim Lo
Yizacheru Al Pi Kha,
and it's regarding this issur. It's
regarding this issur that the Ramah is
paskening based on shittas Toisfos, that
the only time it's assur to be maskir
Shem Elohim Acheirim for a ben Noach is
if he's going to only mention the Shem
of Avodah Zarah. But if there's going to
be a shittuf, then it's not going to be
a problem. So Toisfos and the Ramah's
psak is discussing the issur of Shem
Elohim Acheirim Lo Yizacheru Al Pi Kha.
It doesn't mean that a ben Noach that's
over Avodah Zarah bishittuf, that in and
of itself is not going to be a problem.
And we said that even though this is
mefursam from the Noda BiYehudah, or
more accurately from Teshuvos Noda
BiYehudah, but really there was so many
Gedolei Acharonim that said this as
well. The Yonasan Eibeschutz
in the
rubber full hamburger in the
coin.
The
rubber band in the two of his son of
the prima garden. So many good acronym.
One of the acronym that we mentioned
that was
to this
is the
the is
on this
and you can go on love. He says, quote,
as relates to
those that are the
of course he means the
the nights room who worship the trinity.
Hence, the
iron the
two of them
or the two of them or the two of them
or the two of them or the two of them or
the two of them or the two of them or
the the two of them or the two of them
or the two of them or the two of them or
the two of them or the two of them or
the two of them or the two
of the
which segues us in to the in base
measures
and that is that on Shabbos I had the to
always
to speak by
with the
from the
suite of all of them so far.
And he shared with me a double
and a lot of this is printed in
some of it is in partial
page 37 and some of it is in partial
page ratio dollar and from there you can
refer to the footnotes and the footnotes
and
and some of the 10 but
the kids are the motion is
with my lucky from many places in the
Torah of the so far.
That the
seems to say not like what he wrote in
his
and the shoot of the
seems to be
so far of that really a ben noach is not
musar on shittuf. And again, the nafka
mina of a ben noach is musar on shittuf
or not musar on shittuf is absolutely
flabbergasting. It is not shayach how
big the nafka mina is. I'm trying to
find an expression that brings out this
point. It's an incredible nafka mina
because here's the question. Are
noitzrim avodah zarah or are they not
avodah zarah? I mean, that's a pretty
big question. THE WHOLE MESECHES avodah
zarah is a nafka mina whether yes or
whether or not. So, if ben noach is
musar on shittuf, then the answer is
they're going to be avodah zarah. If
they're not musar on shittuf, avodas
hashilush is not considered avodah
zarah. Now, by the way, as it relates to
the Ishmaelites, that we covered
clearly. That's often in Rambam's and
Rav Ovadia in his teshuvah says without
a question, it's not even A SUGYA. FOR
SURE THEY'RE NOT considered avodah
zarah. So, if the Ishmaelites are not
avodah zarah and the noitzrim are not
avodah zarah, well, then you're going to
have to travel to the Far East somewhere
to find a real avodah zarah. And this is
really not going to be so negiah.
Certainly not as it relates to the akum
she osik b'mitzvah. But, the Chasam
Sofer seems to be going with the
mahalach of all the gedolei acharonim
that learned up
in the Rambam and Tosafos that they only
met regarding the issur of shemuah
l'akum she osik b'mitzvah. But, the
answer of ben noach is musar on shittuf
stating that said Rav Moshe that
if you look around in the Torah of the
Chasam Sofer, it's very not poshut. Now,
truth is there's so many Chasam Sofer's
now
that Rav Moshe was malach that we
could speak out, but I'm just going to
mention two.
Only because of specific I did the
chabiva way. The first one is
the Rambam in Hilchos Melachim and this
is perek yud, halacha yud tes and
halacha yud yud. These are very, very,
very important Rambams. Rambam says as
follows. Again, we're learning meseches
avodah zarah now. So, really this is
only inyan l'inyan b'inyan l'inyan to
what we're learning. This is classic ben
noach classic. So, the Rambam perek yud,
halacha tes, Hilchos Melachim. He's
talking about ben noach. Says the
Rambam, akum she osik b'Torah chaimis,
a that learns Torah chaimis, lo
ya'asik el mishpat
>> that
a guy who learns
But as it relates to other myths voice
a guy that rests even if he doesn't have
a weekday not on Shabbos per se and
he treats that day like we treat our
Shabbos Mesa.
without saying
if he makes a Yom Tov Shabbos is a
problem.
We don't allow the
to be
a Dos. The last myths voice
and just to do myths voice.
A guy wants to do more than the seven
myths voice we give him two choices.
BECOME A GOOD GUY.
OR DO YOUR SEVEN MYTHS VOICE
THIS IS WHAT THE RAM SAYS.
SO THE RAM SAYS
You
can't just make up stuff.
You have two choices.
Or
for loy
This might be the most famous Ram I've
never heard. I mean it's a very big Ram
over here.
Now just let's take apart this Ram
before we even start. And that is what's
the Ram I'm saying? The Ram I'm saying
everybody knows the Ram I'm that says a
guy that keeps Shabbos is a righteous
man." Everybody knows that. Everyone
knows the Gemara that says a guy that
learns Torah is a bad thing, right? Says
the Rambam, "Don't think that when the
Torah and Chazal singled out those two
inyanim, it's only those two. It's not
only those two. It's true for
everything. In fact, there's a klal over
here." Right? The Rambam klalizes this,
right? Turns this into a klal.
You learn those Gemaras, it's this, it's
that. No. There's a klal. That's what
klal she l'davar means. This is not A
PRAT. THIS IS A KLAL.
GOOD? This is Halacha Test. Ready for
Halacha Yud? You sitting or you
standing? Says the Rambam,
because
why not?
Let me get rewards.
KNOCK YOURSELF OUT. YOU WANT TO DO IT,
DO IT ALL DAY, EVERY DAY.
HE BRINGS A CARBON OIL.
NOT JUST THAT.
WHY?
BEING THAT HE IS SUPPORTED BY the
Yidden,
and in fact, there's a mitzvah there
to
help him. So, if there's a mitzvah TO
HELP HIM,
BUT A CAN GIVE STOCK AND
THEN WE'RE GOING TO GIVE IT TO A
NON-JEW. GO HIM.
I push it. Don't know how to make heads
or tails from these two Rambams. The
Rambam in Halacha Test says that if a
guy wants to do mitzvahs, he can.
But a non-Jew that wants to ask his
mitzvah from a non-Jew that Torah, Today
we couple star in my noise with glasses
like a cool house. And the safer says
this is from the most blatant steers of
all time BETWEEN TWO RAMAMS. MAMA'S ONE
RAMAM after the next. Halacha can't
do more mitzvahs. And in halacha yud if
he wants to do more mitzvahs
GO DO MORE MITZVAHS. WHAT'S OVER HERE?
AND THEN THE SAFER goes and he asks
another five or six cashes. Cash after
cash after cash. By the way, this safer
if you want to look it up is al hashass
maseches Sanhedrin daf nun tes. And the
safer fears this for a line. He says the
shaalti picha ramam.
So I'll be honest, I was so lost I asked
the ramam. For all the plain dark good.
Lechelik ben a broken bidvorim in
miskabelin.
I heard different eitzas but everything
I heard is a dovish in miskabel but you
can write your minyan. And everything
that they were saying all these need
riyas and votes. I didn't hear anything
that's miskabel
so the safer says I couldn't come up
with a myself. The shaalti picha ramam
and there was no one who was able to
tell me anything that to me was a
miskabel. This is what the safer is
saying. And again, there's so many
cashes that the safer asks I'm sure if
you want to see it inside but the cashes
in your name is this steer. So says the
safer that because of everything that's
going on over here. The neural state of
the ramam. I'm going to tell you what I
think in this ramam is. I think in this
ramam is that in halacha tes
the ramam starts off akum b'toras
some have an edited version a censored
version that says b'toras. But akum
b'toras misha. And in halacha yud the
ramam says ben noach sh'rotzeh la'asos
mitzvah mitzvos
so the safer says I think the difference
is one is talking about an akum and the
other one is talking about a ben noach.
What's the difference? They're the same
thing, right? No, it's not the same
thing. An akum
means an any yehudi but what is the
literal ta'am of an akum? Oved kochavim
umazalos. He's an oved avodah zarah. A
ben noach is a yehudi. but what's the
literal type of a
he's an
HE'S FROM THE
NOAH IS
HE WASN'T
BUT ALL THE WAY THAT YOU SAW
starts from
BUT SEVEN MINUTES
THAT FOR SURE YEAH
guy that any
is an over the desire
The
says the
that's talking about somebody that keeps
the seven minutes
what's the difference what's the
difference so if someone's an
and he wants to do more minutes
we're not going to allow him to do more
minutes but if someone is keeping the
seven minutes HE'S A
LIKE NOAH
AND HE WANTS TO DO MORE MINUTES THAT
PERSON we're going to allow to be my
friend and minutes says the I'm going to
tell you what the you ready
to manage He says because an
when he's over the
what does he have in mind he has in mind
is
being that he has in mind IS
SO IF YOU'RE GOING TO TELL HIM YEAH PUT
ON NOW YOU WANT TO PUT ON PUT ON you
want to learn
WHO'S HE LEARNING FOR HE'S LEARNING FOR
HIS
SO YOU'RE BEING
IN HIS
BUT SAYS THE
ONE second one second that's not fair if
he's putting on
probably because he wants TO SERVE GOD
OF THE Jews the why else is he putting
on him So he wants to serve a God of
says the
true but if he's an
he also has his in
his
over the
ONE SECOND THAT'S
EVERYBODY KNOWS IT'S AN
SO HE COULD DO
ALL DAY WHAT'S THE PROBLEM SO CUZ HE'S
ALSO AN
HE HAS A MIND
TO BE
WHO CARES HE'S NOT
SAYS THE
THE WAY NOT
it's true but
but the Torah this is the punchline of
the rabble. This is such fire. THE TORAH
SAID WHAT IT'S motor for
to do it off.
THE TORAH SAID SEVEN MINUTES and if you
do these seven minutes because this is
what you're supposed to do and you have
in mind that only the
but you also have in mind you have a
desire that's fine because of
and we understand that that's okay.
That's what we
do that's fine. You have you're allowed
to be a
he's not
but at the same time only what
we know he's allowed TO DO BUT
AND IF WE HE WANTS TO GO AND BE
IN his
that's already crossing the line and
that you can't do. So if he wants to
keep
being that we know he's going to be
so comes out with FACILITATING AND
AND THAT'S NOT what I mean
that's true
copy with the Torah with
THAT IS NOT
COPY DESIGN THAT'S HIS
HE'S NOT
ALLOWED TO BUT HE WANTS TO GO NOW and he
wants to be
so that already can't do cuz now he's
violating
I agree he's not
he's not
for what we know he's not
but you're going to go ahead and you're
going TO BE
NEW
WHERE YOU'RE GOING TO BE
IF
THERE'S ALREADY A PROBLEM BEING
AND THAT'S NOT SOMETHING HE'S ALLOWED to
do. THAT'S
A LOT OF
OPEN HE'S NOT ALLOWED TO HE'S NOT
ALLOWED TO
THAT'S PERFECT. YOU WANT to do more
other do anyway he's not being
but I think it doubles down on that he
says I prove to you I'm right.
Because the rabble says that in the
event that the and gives stock of a year
should nice and nice and
what do you do with the stock give it to
the
cuz being that this person is supported
by Israel and
you didn't have a
where do you find that he has a to be
and any you would do it.
Where do you find it? It's a passing in
the Torah. You find it by the Gittin
20a. It says "V'chai imach."
In other words, says the Chasam Sofer,
it's mefurash in the Rambam that the
Rambam's talking about someone that's
not over the avodah zarah. The truth is,
it's mefurash even more than that in the
Rambam. It's mefurash in the Rambam that
we're dealing here with a ger toshav.
It's mefurash. Cuz the Rambam says
"Ho'il u'hu nisa b'Yisrael, mitzvah alav
l'kayem." That's the nekudah. The
nekudah is The nekudah is that in
Halacha it says the Rambam's talking
about an akum. An akum isn't over the
avodah zarah. And
if he's going to be mosif mitzvos, it's
going to start to serve the avodah
zarah. Ah, he has a mind of a ba'al
seichel, a mind of a ba'al seichel. It's
true he has a mind of a ba'al seichel,
but he also has a mind of his kishke.
And because he also has a mind of his
kishke, IT'S A PROBLEM. AH, YOU HAVE to
know the sheetah of that's only for the
sheva mitzvos in THE HALACHA GEDOLAH.
BUT IF HE WANTS TO BE MOSIF IN HIS
AVODAH SHEETAH, that's already something
that's going to be a problem. Halacha
Yiddin, I'M TALKING ABOUT A GER TOSHAV.
OH, GER TOSHAV I GET. BUT IF HE'S A GER
TOSHAV, it's going to be fine. The
Chasam Sofer throws in one more chiddush
here that's worth mentioning. So much
here that's not right. But there's one
more chiddush that we have to mention.
And that is when the Chasam Sofer says
that in Halacha here we're talking about
a ger toshav. So what's a ger toshav?
Someone that keeps sheva mitzvos, right?
Wrong. What's a ger toshav? The Rambam
says so many times, that's the miktav of
Moreh Nevuchim in the end of the Sefer
HaMitzvos where the Brisker Rov isn't
makes all the diyukim that a ger toshav
is someone that's also mekabel. So the
Chasam Sofer says something again. You
have to be a Chasam Sofer to say all
these chiddushim. And that is a ger
toshav is not only someone that's
mekabel to keep sheva mitzvos.
A ger toshav is not only someone that's
mekabel not to be over the avodah zarah.
A ger toshav has to be mekabel not to be
over the avodah zarah a few beshituf.
It's the ma'aseh. Even though the Chasam
Sofer says "I hold that the Noachide is
not muzhar al shituf k'pshuto."
BUT A GER TOSHAV THAT MAKES A KABALAH,
HE HAS TO BE MEKABEL NOT TO BE over it a
few beshituf. I think this Chasam Sofer
maybe We have to think this through a
little bit better. But I think maybe
this answers the Sho'el's kasha, who we
know it Reb Chatzkel Abramsky. In that
last michtov in the Brisker Rav, where
the shoyel asked the Brisker Rav that
what's the kabbalah of a ger toshav? A
ger toshav is anyways chayiv in sheva
mitzvos bnei Noach. Every ben Noach is
chayiv in sheva mitzvos. So, if a ben
Noach is chayiv in sheva mitzvos, so
what's THE KABBALAH? YOU CAN'T BE
MEKABEL SOMETHING YOU'RE ALREADY
MECHUYAV. SO, THE BRISKER RAV SAID,
BASED on the dikduk of the gemara in
that base on the base, "Rov Yaakov Goyin
is chayiv in kedushas Yisroel." Which is
told in the tshuvas Pnei Yeshua and the
Bamah Ginish But, this Ksam
Sofer was a little bit of a giluy
because a ben Noach is chayiv in sheva
mitzvos, but he could BE OVED BESHITUF.
BUT, A GER TOSHAV CAN'T BE OVED
BESHITUF. YOU KNOW WHAT THE KABBALAH IS?
"I'M ONLY GOING TO SERVE THE creator of
the world." And it doesn't only affect
avodah zarah, IT AFFECTS ALL SEVEN. ALL
SEVEN MITZVOS, I'M NOT DOING IT FOR a
gashka ANYMORE. I CAN'T BE OVED KOCHAVIM
U'MAZALOS ANYMORE. I feel beshituf I
can't be oved KOCHAVIM U'MAZALOS. MY
GANZ AVODAH HAS TO BE FOR KUDSHA Brichu
alone. But, the bottom line is But, the
bottom line is
What do you see from this Ksam Sofer?
This Ksam Sofer screams from the
rooftops, "Ben Noach is not muzhar al
shituf." It's a full shiyur of Ksam
Sofer anyway. The whole shtickel, the
shtickel is marvelous, fire. But, the
whole shtickel is ben Noach is not
muzhar al shituf. Mention one more Ksam
Sofer. And this is in
Pirus Moshe, it's in Parshas Zav. It's
also again, about
this inyan many times. This is a dvar
gadol. And that is
the Medrash says, it's a Shmuel Rabbah
mem gimmel alef, that when Moshe
Rabbeinu, we know when he came down, he
saw that the Yidden had worshipped the
eigel. What did he do? He broke the
luchos. And shviras haluchos is a very,
very big deal, right? Like in the kol
Yisroel, the last Rashi in Chumash, last
words in the Torah is related to shviras
haluchos. That's like the final uh
analysis. Like we said, the last thing
we mention about Moshe Rabbeinu is
shviras haluchos, which was not by any
kol Yisroel. But, the bottom line is
what was the greatest zach, this big
inyan, this avodah of shviras haluchos?
Somehow it seems like it saved the
nation. Why was that so critical? So,
the Medrash says, "Mashal l'mad
l'dayma." There was a melech that sent a
shliach to be mekadesh an ishah. And he
was mekadesh the ishah. On the way to
meet the melech this isha was not FS,
right? She was mizana
and everyone knew that she's dead
because the king is going to kill her. I
mean, she's the wife of the king and she
goes ahead and she is mizana. Aluva
kalash is in
like what's going on over here? It's
going to be a big problem. So there was
a serosa, there was a broker, right? The
shatkin, the person that made this deal
happen. So what did he do? He took the
shuba and he tore it up. I'm not saying
should be done in the new year. The like
this the very least it won't be treated
like an
says the madras
give me
when the did they go? So much of a
realized that you didn't want to be
punished like a fish that was since
they took
there's no hope for
so he broke the
he tore the proverbial
and by doing that he was able to save
the past we mentioned the
in the beginning of
Lee
Lee Lee Lee destroyed the Lee and if you
don't have that relationship of Lee so
this
the
between
and is not on the same level like this
is not going to be such a big problem.
But
brings this madras and he says
I think
I want to say a little bit of a
different
and that is what was the
it was
right? But the says
that
in
love
bring me back to my days
in love should have a lot of her.
This is how you throw your name is
client. When the worship the ego so they
said
right? They mentioned that taking them
out of
but they also mentioned the
they said
we're not for the fact that they said
I just would have been wiped out. Why?
Because when they worship the they
worship the but it was
because they were worshiping
and they were also worshiping the ego.
They were doing both, both. But were not
for the above, had it not been below
Robin, we'd be wiped out. We wouldn't
stand a chance. The only reason we have
a chance is because it was done by
Shinto. So I'm sorry for the ego that
the more it says was the Zara by Shinto.
A year is not allowed to be over by the
Zara by Shinto. Built in Russia the
robbery. BUT A
EVERYONE KNOWS THE RAMA BASED ON
BASE on the base on
the given up a base. I'VE BEEN A SHINTO.
YOU KNOW WHAT THE motion of the day was?
He went ahead and he broke the tour the
if he tour the
and now
you are not
you still alien. You know what they are?
They're
playing you have to worry about the ego.
It's not a problem. WHAT DO YOU MEAN?
IT'S A GOOD ALSO
CUZ IT WAS SHINTO LIKE THE SAYS IN
SO FOR THAT REASON
BUT WHAT DO YOU SEE FROM THIS so far?
What do you mean? Everybody knows the
Rama. Everyone knows
but
I was a Shinto.
In fact, I must have
in purchase
and footnote perfect. He says it
follows. He says I'm going to be minor
to you a little bit. Of the
with
says this in you that I was
it's in
some say for these in the old that
I am to get more. It's in some say for a
gamble on the coffee and
it's some say for purchase for a moment
it's a good for a moment for a moment
for a moment for a moment for a moment
for a moment for a moment for a a moment
for a moment for a moment for a moment
for a a moment for a moment for a moment
for a moment for a moment for a moment
for a a moment for a moment for a moment
for a moment for a moment for a moment
for a moment for a moment Torah of the
flood. In safer Maggid Mesharim
and Panim Yafos in the end of Parshas
Noach and Panim Yafos in the Parshas
Vayeitzei and Panim Yafos in Parshas
Shmini and in Parshas Pinchas and I just
said if you have the Nuksav Yad Madura
Madura Tanyana Parshas Bereishis there
to the Panim Yafos and the flood said it
come with a come up on the also. So it's
in the Sofer and it comes from the Sofer
of the flood that Noach is not
allowed to all that It kind of
been joyless. What's going on over here?
It's a big problem. The Sofer and his
guys, he brings the Makom and it sounds
like he went like to the Akedah
all hell that only meant it clap you
this one Zach. But as it relates to the
bottom is the
nice is my NAME THEY ACTUALLY LIVE
BEFORE THE SOFER. AND here the motion
is minor 10 different places Sofer and
the floods all over the place with the
Sofer is not that way. Schlemiel said
that it could be Rub the Rub of this
Sofer in the world of
maybe there's a between the of
and the of right? There's a
in
we go like all these
very
very very it's not clear. But I just
want to end with one last beautiful
one.
And this Schlemiel told me in the of
this is not mentioned anywhere in the
Sofer and that is
there's
a safer it's called Keren This
safer Keren was written by a
great guy
whose name was Haas. Haas
was the Beis Din of Dreznes. If you
know, you know. Previously he had been
the Beis Din of Halishav, which if you
know, you know. But the bottom line is
that Haas, this great guy, he
wrote a safer Keren
And he sent it to the Sofer to review
and the Sam reviewed it and he gave him
a haskama on the safer. He gives him a
glowing haskama. Now, we mentioned that
before he became Rav in the residence,
he was Rav in Holleschau.
Who was the famous Rav of Holleschau?
The Shach, who by the way was also Rav
in the residence. The Shach was Rav in
the residence, then became Rav in
Holleschau. Sam Sofer was Rav in the
residence, then became Rav in
Holleschau.
Rav in the residence, but anyway. So,
the Shach was the Rav in Holleschau and
he said when he was in Holleschau he
came across a Chavya. A Chavya from the
Shach. It's a drasha
on the Haggadah shel Pesach on the
common mylis toyvis u'chulis, right? The
dayenus. And the Shach writes this
beautiful drasha and he says, "I'm
printing the safer now and I found this
drasha from the Shach. It's it's never
seen the light of day and I want to
print it." Like this the world is going
to know about this drasha. And at the
end of his safer, the last pages of the
safer he has this drasha from the Shach.
So, the Sam Sofer in his haskama
in his haskama to the safer Kerem
he writes as follows. He says he
went through the safer and it's not
shaya. He says, "I don't know how this
Yid was able to write as much as he
wrote. Must be because he's learning
Torah lishmah." And the Mishnah says,
"Kol lo limed Torah lishmah zocher
l'churban Harbei." This is what he
writes in the haskama. And then he says
as follows, "V'ayl kideish gefen
yichidi, Kerem right? V'ayl
kideish gefen yichidi, ki hikra sham
yodei drush echad miksivas yodei shel
ba'al hashach zichro tzaddik l'vracha,
shehaya ba'al habayis b'kilo k'doisha
Holleschau."
He said he had stumbled upon this
drasha. Says the Sam Sofer, "We're going
to enjoy this because we just had this
in the daf yesterday." Makom sheyibola
eitz sham yipara eitzav. And it makes a
lot of sense he would have found it. Cuz
don't Chazal say Makom sheyibola eitz
sham yipara eitzav? We had that with the
braysa of Bar Kappara, right? In that
city where Bar Kappara lived in Parvod,
there was someone that knew a braysa of
Bar Kappara cuz Makom sheyibola eitz
he's mamesh quoting a Gemara. But
anyway, Makom sheyibola eitz sham yipara
eitzav pri kodesh she'elulim. What is
it? It's a Nachman ben No'im al tes vov
toy vois kfulois she be say there
Hagada. The Amarity said the Chasam
Sofer I went through this drash and I
said "Ilu loy bo el abishul zeh, had he
written the sefer only for that?" What's
the next word? Dayeinu, that would have
been enough. This is what the Chasam
Sofer writes. So Yaakov said that
he went through said he went through the
drasha the dark length of drasha a
little bit. A drasha that the Chasam
Sofer If such a Chasam Sofer drasha from
the Shach, go find drasha from the
Shach, I challenge you. And by the way,
in case you're wondering Shach al ha
Torah was not written by the Shach.
Shach al ha Torah comes from the
Talmidei Ari. So it's not from the
Shach. So go find a drasha that's six
pages long. So he's going to have to do
something about this. But go find a
drasha that's six pages long from the
Shach. But either way, so if you go
through that drasha also, one of the
things that the Shach says is like this.
Everyone knows that when the Yidden came
to the Yam Suf, the Yam Suf didn't want
to split. Why? Because the Yam Suf said
"Halalu ovdei avodah zarah
v'halalu ovdei avodah zarah." Right?
What's going on over here? Now the
Mitzrim the Yidden ovdei avodah zarah,
it's true they ovdei avodah zarah but
try and fix says the Shach. But now
already they did teshuvah. So they did
teshuvah they're not ovdei avodah zarah
anymore. But it's not so poshut. Why?
Because we know that they had the pesel
Micha with them. Pesel Micha went along
the Yam Suf with them. Oh but says the
Shach, even though they had the pesel
Micha, even though they had the pesel
Micha, but at the same time at the same
time they were also being oved Hashem.
So if they were also being oved Hashem,
well at this point then l'chayra it
shouldn't be a problem because they're
being oved Hashem. The
answer would be it's true they're being
oved Hashem, but they're also being oved
the pesel Micha. In other words, shituf.
So essentially what was this face off
over here? This the Yam Suf doesn't want
to split. Halalu ovdei avodah zarah
v'halalu ovdei avodah zarah. But
ultimately it's going to split. What's
the Shach al ha Torah? So he says the
Shach al ha Torah was the Yidden at that
point, that moment, do they have a din
of a Yisrael or do they have a dinner of
a Ben Noach? Right, the Mishnah Berurah
brings this
Do they have a dinner of a Yisrael or do
they have a dinner of a Ben Noach? If
they have a dinner of a Yisrael, then
they're not allowed to be over the
Mishnah Berurah. BUT IF THEY HAVE A
DINNER OF A BEN NOACH, THEN THEY ARE
ALLOWED TO BE OVER the Mishnah Berurah.
In other words, THIS IS WHAT'S GOING ON
OVER HERE. BUT THE SHACH SAYS MEFURASH,
IF THEY have a dinner of a BEN NOACH,
THERE'S NO PROBLEM OF AVODAH ZARAH OR
AVODAH ZARAH
BECAUSE Mitzrayim is not Avodah Zarah.
They did Teshuvah already. Otherwise,
they have the Pesel Micha. SO, IT'S FINE
TO HAVE THE PESEL MICHA, but they're
still being over THE MISHNAH BERURAH.
SO, IT'S OVER THE MISHNAH BERURAH AND
SAYS THE SHACH, AVODAH ZARAH BEN NOACH
THERE'S NO PROBLEM. THAT'S THE WHOLE
SHACH OF THE TORAH. THAT'S the big
Machlokes that's going on in the
celestial world. Whether this should be
an issue or shouldn't be an issue. In
other words, the Shach Shita seems to be
The Shach Shita seems to be that what?
That it's Mutar for a Ben Noach to be
over the Mishnah Berurah. Now, this is
gevaldig. You know why? Because if you
remember the first rate by that we did
on this, after all the rate we spoke out
that the Shach says in Siman Kuf Nun
Aleph in Hilchos Avodah Zarah, HE BRINGS
MEFURASH THE PSAK OF THE RAMAH Hilchos
Avodah Zarah not in the laws of a Shem
U'Malchus Lo Yisa Shav L'Vatikha. In
Hilchos Avodah Zarah, the Shach says
Mefurash, couldn't be more Mefurash. The
Shach says Mefurash that Ben Noach are
Mutar Mishnah Berurah regarding
different Halachos of Avodah Zarah. So,
it's Mefurash that the Shita of the
Shach was that a Ben Noach is not Mutar
Mishnah Berurah. And if that's the case,
as the Shach Shita says stating that
after all this rate, I don't know what
Shitasos anymore. Why? Because he sees
the Sam Sofer held like the Mordechai
and like the Besamim Rosh
and he held like the Rebbi Akiva Eiger
and he held like the Pri Megadim and he
held like Rebbi Shmuel Landau and he
held like the Sha'ar Ephraim. Ready, he
held like all those Gedolei Acharonim
that what? They really Ben Noach is
Mutar Mishnah Berurah when it comes to
Gerushin and all the Gerushin of the Sam
Sofer and the Ben Noach was Mishnah
Berurah. So, this is a Mamesh a classic
example of of In Mashiv Al Halacha
but the bottom line is The bottom line
is that the first class this Shach would
seem to be the Shita. Again, Rubai the
Rubai what we spoke about now. I heard
from my great Reb Moshe Schlamowitz. And
we're going to stop here.
