Day #42–Rambam DAILY Sefer HaMitzvos

is day number 42 of our daily study of ram Safar amitzvahs and we have again today the same Mitzvah as yesterday I'll introduce it negative commandment number 322 Lai savaru do not Kindle a fire Okay so yesterday we spoke about an incredible lesson taught based on this Mitzvah on the first yard site of that episode if you didn't watch yesterday I really personally just want to encourage you to go watch it because it's a I think it's very special um let me talk more about the technicalities of this mitzvah there's a discussion I mentioned it yesterday that we already know that kindling of fire is one of the 39 forms of Labor so why is it specifically singled out to be mentioned uh on its own so that's a discussion that takes place in the gamada in Shabbos and there are a couple different explanations from our sages about why kindling a fire is specifically mentioned explicitly as opposed to the other uh forms of of malacha of productive creative labor but I'll tell you the the explanation that is actually the definitive one as far as holaically and that is that the Torah singled out this one malacha to teach us that each and every malacha to teach us something about all of the malachas that each and every malacha stands on its own in the context of somebody who let's say violated God forbid several uh malachas he did several malachas different malachas and Shabbos so would he be obligated to bring merely one Corbin hatus one sin offering for violating Shabbos or for each and every different malacha that he performed and we learned from this the fact that this malacha is singled out that we would break it down we'd give them an itemized uh bill for how many uh sacrifices you have he would have to bring based on the the different malachas that he did and we learn it from this now you can ask me an intelligent question which is if so so then leisavaru aish is not a distinct Mitzvah it's teaching us something about a Mitzvah that we already know about so then why is that I'm included as one of the 613 that's a great question okay because also we learn from this prohibition to specifically light fire that I'm says that um this is based on the yirushami on the Jerusalem talmud that this teaches us that the high court which administers the four forms of capital punishment which we're going to learn about much later in the last of the 14 books but the high court which administers capital punishment one of those forms of capital punishment is burning and because it's prohibited to make a fire the Kindle of iron Shabbos so the court is not allowed to administer that capital punishment on Shabbos or any capital punishment or for that matter to adjudicate any case so we learn from this prohibition that the court should not administer the death penalty or hold session at all on Shabbos that's the prohibition the court should not hold session on Shabbos and we learn it from this mitzvah today's Mitzvah okay we'll see you again tomorrow God willing
