So, he says, "You could be sameach on
this, start the first Shemoneh Esrei,
have a das to say it, and if it's zman
muflig you have a safek, ignore the
safek."
Then he says, "But, maybe people that
are busy thinking about the business,
more they think about this Shemoneh
Esrei, so what are their das? Not in the
davening at all, maybe then it doesn't
work." But, he does say it works for the
average person.
The Shevet HaLevi Chelek Gimmel Siman
Mem Gimmel, interesting, the shoel said,
"I heard from the Debreciner Rav, I used
to live mamash around the corner,
and the Debreciner Rav said, 'This Taz
and this Magen Avraham do you have das
to say it and you definitely didn't
forget, does not work in our times, cuz
people are so disconnected from the
davening, they're so busy with their
business.'"
He says, "It doesn't work. You start out
by Shemoneh Esrei, good, then you're
going to say a minute later you're at
work, two minutes later you're in
Florida,
and then comes the Al HaNisim, you're
going to remember."
And he brings a raya, the shoel, because
the heter of 90 times 30 days in
Shulchan Aruch, there's no heter of
having a mind before you start.
So, Rav Vozner says, "I don't agree,
because l'maaseh,
if a person is davening with das to say
it, and he had a mind to do it, why
think that he changed?"
He says, "Of course, he says, 'If it's
yaina davening and yaina davana, then
you can't be sameach on it.' And that's
why the Shulchan Aruch couldn't give an
eitza of having a mind to do it. You
know why? Cuz the person might forget if
he had a mind to do it also.
He's yaina davana and yaina davening.
But, if someone took a serious approach,
I have to every morning until we we get
to the 30-day period, I must change
say Mashiv HaRuach and say Morid HaTal,
you could rely
if he was davening connected that he
said the right thing. So, this is very
relieving to us, we have a new way of
approaching a safek. When someone
starts, and I tell people a good idea on
Motzei Yom Tov
Pesach the first days, you have to make
a mental note of four additions to
Shemoneh Esrei.
First of the first time we stop saying
Mashiv HaRuach or Morid HaTal, or if you
don't say Morid HaTal, then we have the
saying Ata Choneinanu, the saying
Bracha,
and and Al HaNisim. And then Al HaNisim,
sorry, Al HaNisim, and that's the
fourth. Say
Morid HaTal, say Bracha, Ata Choneinanu,
and Al HaNisim. Now, the problem because
some people announce the saying Bracha,
because the first time we're changing,
which is important. But, is that mamash
mean that you don't have to say anything
else? So, some people clapped four
times, okay. But, l'maaseh, if you start
with the resolution the four additions,
we have this Taz to be sameach on, but
here's one point that I want to mention

said Modim,
"Uh-oh, did I say Al HaNisim?"
So, Akiva Emden, time is of the essence
in this shaila. The question is when the
safek began. And Akiva Emden gives you a
little bit of an insight into the
psychology of a human being.
When you have a safek if you said
something right after you're supposed to
say it,
so be it, what are you thinking? You
just said it. You don't remember saying
it? Where where were you? Where are you?
So, if you have a safek right away or
close enough that to when you're
supposed to say it, you probably didn't
say it. But, then he uses this term,
he's the first to use the term, but
let's say the safek was nolad in zman
muflig,
a
a long amount of time, we'll soon define
that. So, then there's no raya
that you don't remember.
And I think he means to say is a person
that that is a chareidi. What does
chareidi mean? He's devoted. He's
worried about the Shemoneh Esrei. So,
he's careful, Al HaNisim, I have to say
it. He gets to the Al HaNisim, he says
it, he gets to Modim, he finished
Shemoneh Esrei, and now we're doing
something else.
So, he was yoitze. He feels confident.
So, he goes from his mind to his
archives. I davened Mincha today, baruch
Hashem. Do I have to remember saying Al
HaNisim? I mean, till when? Until until
Mashiach comes? So, zman muflig, you're
not mechayev to keep on remembering, cuz
you did it. So, it's already processed.
Zman katzar, there's a raya, so where
are you? You said Al HaNisim, can you
remind yourself? No recollection. Make
up your mind.
So, Rav Akiva Emden stresses the word
zman muflig versus a short time.
Then he says, "I know about myself,"
also a story about himself, "I once had
a safek zman muflig, I was about to
daven over. I said, 'No, no, I remember
I said it.'
Because zman muflig is very much a heter
not to daven over."
And then he says, "This could be the
chelek between the Bavli, between the
Yerushalmi and Brachos and Taanis. It's
zman muflig, you don't have to daven
over, but right away you do."
And then he adds something that is very
puzzling. "Shir Matzasi l'haTaz, I found
the Taz that I just mentioned. The Taz
says, 'If you start with the resolution,
you don't have to daven over.'
V'ha'amaineni and I have a normal oid,
that I was mechaven to the ha'eilechu
gitas."

The Taz said something about that you

Akiva Emden said zman muflig. So, what

you look in the Siddur Yaavetz, Yaavetz
Siddur in the new print is on the top,
chelek aleph, top sof kuf mem ches, he
says, and I quote, "In baruch she'haya
b'diya b'diya seilaim before he started,
and achas zman muflig, you have a safek,
you're good." So, exactly why why why he
didn't write it clearly, but one thing
he writes in the Siddur, "When can you
be meikel? If you have a combination.
Number one, you started with the das,
'I'm going to say it, I'm going to say
I'm going to say it,' and the safek was
nolad zman muflig, the Magen Giborim,
much later in Kuf Yud Daled Siman Nun
Beis, "Chaim, when are you meikel? In
baruch she'b'diya l'zkor min ha'ura,
u'l'achas zman muflig nafal safek
b'libo." And the Poskei Acharonim,
Mishnah Berurah in two places, Kuf Yud
Daled Siman Nun Mem Ches, Tof Chof Beis
Seif Katan Yud, says, "In baruch
she'b'diya l'zkor min ha'ura,
b'seches tefila, u'l'achas zman muflig
nafal safek b'libo,
don't daven over." And he says his makor
is Magen Avraham and Magen Giborim.
So, again, the Taz is a little bit
tzarich iyun, you know,
what is that enough, one one thing?
Mishnah Berurah in Shaar HaTziyun says
it's not enough. But, one thing we are
comfortable to say l'halacha l'maaseh,
if someone started Shemoneh Esrei
thinking I have to say today Al HaNisim
or Mashiv HaRuach or leave out Mashiv,
whatever it is,
and zman muflig he has a safek, we have
the Magen Giborim, Akiva Emden, Mishnah
Berurah in two places, he doesn't daven
over. Now, l'maaseh, of course, if
someone started Shemoneh Esrei and I
think about anything,
then it's no good.
Rav Zalman Auerbach

says a big chiddush,
if someone remembered before the bracha,
right before the bracha,
that he has Now, baruch I better say the
saying bracha, no Tal U'Matar today.
And then right after he finished
Shemoneh Esrei, he has a safek, then he
can be meikel.
If right before the bracha you plan on
saying it, I mean, that forgetful,
you're not. So, this is somewhat of a
chiddush, but one thing which is very
common, a person starts Shemoneh Esrei,
knows what he has to say, and he has a
mind to say it, and zman muflig, we'll
soon define that, this is enough to be
meikel.
If someone started without thinking
anything, and then he has a safek zman
muflig,
they have to repeat Shemoneh extra,
because it's my muflick only impacts
when someone has a safek. You have no
safek. You didn't start thinking
differently.
What does man muflick mean?
So, the truth is it's a question,
because
mashiach
is much earlier than ya'aleh v'yavo.
And some shmoneh esrei is 5 minutes, 4
minutes, 10 minutes, 20 minutes.
So, I think that man muflick is when is
there a no longer re'isa that you should
have remembered? A person knows right
after shmoneh esrei, uh you know, when
he finished shmoneh esrei and he can't
remember.
How could you not remember? Now, what's
typically a shaila? When does a person
have a safek if he said ya'aleh v'yavo?
You know when? When the shliach tzibur
says ya'aleh v'yavo.
So, I saw Reb Moshe Matisyahu in the
Sefer Hilchos Yom Yom, he says that's
enough of a zman muflick. Now, even
though l'ma'aseh it's not so long after
in time, but after shmoneh esrei and
after that he processes it, that could
be a zman muflick and therefore you can
be makeel.
The Shmi'as Shimon ben Asher in the Zera
Yitzchak what does man muflick mean? Is
it totally in the ending shmoneh esrei,
the long shmoneh esrei? So, it's hard to
give a klal, but if a person feels he no
longer expects himself to remember what
he said, because again it's processed,
it's finished, that would be a zman
muflick and you don't have to repeat the
shmoneh esrei.
The
interesting question and I mean this
question has come up when a person asks
and he says, "I am pretty sure that I
said ya'aleh v'yavo, shachris, mincha,
or maariv, or whatever it is, I'm pretty
sure I said the right thing."
So, you have to know one thing, it's
it's really telling a person. When a
person says pretty sure and he's a big
anav and he's a big yarei v'chareid,
pretty sure means I said it, but he
can't, you know, make a shvu'ah
d'Oraisa. But if he has a little bit of
yir'as shamayim, a pretty sure, that
means he's saying he's pretty sure he
said it.
If someone says it and I say he's saying
I'm not sure, pretty sure,
so it's really
a language a person uses. Reb Moshe
quoted by the Sefer Reb Zalman
Sefer that Reb Moshe said if you have if
it's karov l'vadai that you said it,
you could be makeel. Now, I don't know
where Reb Moshe's lashon exactly was, so
it's hard to bring a raya from that, but
if someone feels that perhaps he's
pretty much noite that he said and he's
a person that that's thinking is yir'as
shamayim,
that avad the yesh al mi lismach to be
makeel.
If someone nebach is always b'safek,
unfortunately this is a machlokes, this
is OCD, anxiety, nervin,
I think since the the Chaim's time it
has doubled and tripled in various
But l'ma'aseh,
this is poshet nervin not a safek.
Nervin is a is a machlokes. So, he
doesn't remember anything, but that's
certainly not considered a safek. So, I
care the only way to do it tell these
people, "You did say it and go vite
until they start, you know, giving up
some of the nervin." But that's zicha
not a safek.
What is a painful safek a person has a a
a memory failing?
And he forgets. A person has as a
shikor, a machlokes shikor.
So, it's interesting how to look at it,
because
the fact he doesn't remember what he
said a minute later is not a kasha.
Doesn't remember.
Unfortunately, even more said if he
started shmoneh esrei I must say ya'aleh
v'yavo.
Also not a right klal, because he might
have forgotten.
But then again, could be his hair goal
for the past 6 months saying mashiach
during the winter doesn't impact what he
said today.
So, what I I found takah the beautiful
Sefer Siach Mordechai on takin yonim men
Mordechai,
he says very briefly, so he has no
chazakah and he can be makeel.
What I think he means to say is emes
like I told you earlier, same yishuv
ha'da'as. Really, a yid said the right
thing. First he concentrated his
davening, why I think he made a mistake.
Novos,
there's more to it. This is about safek
d'Oraisa d'Oraisa d'Rabbanan.
If you have a chazakah, chazakah is a
brick wall.
Once you have a dent in the chazakah,
then you're back to safek d'Oraisa
d'Rabbanan.
This person that's forgetful has a dent
in the chazakah. It's no chazakah.
So, here we rather say there is no
chazakah, he's back to safek d'Oraisa
d'Rabbanan
and takah such a person doesn't have to
daven over,
doesn't have to daven over his shmoneh
esrei, because again there is no
existing chazakah. Either way.
If someone is brave enough to admit and
someone once told me this, he said, "You
know, I'll tell you the I have a safek
if I said ya'aleh v'yavo. But my shmoneh
esrei left much to be desired. I was
here, I was there, I was anywhere but in
shmoneh esrei."
So, let me read you a lashon of the
Tanna Yisrael.
Chaim ben Asher in Ein Yaakov, im yima
sh'al b'rosh chodesh u'v'seichach
t'fillah nischashuv sh'chodesh. You
hear? This fellow was obviously thought
about saying it during shmoneh esrei.
This what the what Reb Zalman
said works.
U'keshe hislim nistapek in hiskoyloy,
what do we do?
So, he says teshuvah, this is a
teshuvah, right? B'sha'ah achas
y'val'uhu elef ra'ayonois.
U'vadai sh'lo hiska.
Within a a few moments you had a
thousand other thoughts.
Now, that's a chiddush, because if a
person does not was not on business or
on vacation during shmoneh esrei, why I
think he changed. But let's say a person
admits my shmoneh esrei was just like he
said. B'sha'ah achas y'val'uhu elef
ra'ayonois. I went here, I went there, I
went anywhere.
Then he lost the that's the problem. But
one thing we'll say that if a person
takah thinks that he was all over the
place, it's hard to say if he said the
right thing. And if he fits into that
description, he has to daven over if he
has a safek.

tissue out of the siddur and put it in
my pocket? I really shouldn't keep a
tissue in the pocket in the siddur, but
you know, maybe I shouldn't do it in
shmoneh esrei. So, I told him,
"That's why it works, because if you
make if you see the tissue, take it out
and put in your pocket, that means you
said ya'aleh v'yavo."
Then you can't have a safek any longer.
Otherwise, you might have a safek. But
if you do some type of a ongoing siman,
and I saw the the Chasam Sofer,
he says bend the page of the siddur on
the top. Now, I hope he's not talking
about the siddur of the shul, because
everybody does it every month or every
day, so it's going to get ruined. Maybe
your own siddur. But the the Chasam
Sofer takah the Pele Yoetz Sefer Orach
Chaim, he in kuf yud daled he says that
you a person be soid v'niskah and he
should
yichbol
b'reisha daf
that he has to do something on that page
ya'aleh v'yavo. And then Reb Gershon
zachar yiskor and the Chasam Sofer in
kuf yud daled he's quoting and down the

I assume he means to say that if

from the siddur, it doesn't give you any
choice. It doesn't say mashiach till
then, it's Rosh Chodesh
and it's everything Rosh Chodesh and
sorry and the chol hamoed and Shabbos
and Yom Yom Tov. So, this is the klal,
if you're davening from the
The Hilchos Yom Yom in kuf zayin is very
reassuring. He says if someone had
kavana by davening
and then
a zman muflick
he had a safek.
