arrived here in Miami, I went and I
asked probably 30
30 plus people
what
what they know about chodesh and yashan.

did daf in the last few days? Good. So,
from the people that didn't do the daf
in the last few days,
is chodesh
and yashan a chumra?
Is it derabonan? Is it doraisa? What is
chodesh? What do you guys know?
What do you guys say?
You ever see on the store it says that
the pizza is yashan?
Not so much these days, huh?
So, I want to read you first an email.
Then I want to show you a
a video that I took.
Dear Reb Eli, this is from
Gershy Rose from England. Very very big
part of the shear. Brought
way over 100 people this year. Maybe I
think it's 200 plus.
With the greatest respect, I wanted to
raise a concern, a certain nekuda which
to my knowledge has not been really
addressed.
I fully recognize that Reb Eli speaks
with passion. There are certain areas,
almost like pet peeves, that come up
regularly. I was wondering if I could
back on a few of them and share a
thought. Firstly,
when it comes
to talking during kaddish, it is clear,
strong, and undisputed. It is something
we all understand. It's something I
personally am careful with. We're here
in Nicks
and he got me thinking when I came to
when I saw
in the other show how he's so makpid on
talking during davening. And I said,
"Ah, if they could do it in Nicks, I
could do it in my show. I could do it in
MDY." And so,
we we instituted in MDY and it works
beautifully.
But, I said, "You know, for the oilam,
not in my show, people that watch the
shear, maybe they could start with
something small and super important
that's kaddish, not the talking during
kaddish." So, he agrees with that.

Secondly, regarding ma'aser sheini,
again, it's a halacha widely accepted
and something Reb Eli has given
tremendous chizuk
over the years. Personally, I've been
doing it daily for decades and I'm
genuinely grateful for that chizuk.
When it comes to not learning during
chazaros hashataz, this is spoken about
often. However, my own rebbe, a leading
posek in Eretz Yisrael, taught us that
since many people unfortunately are not
properly listening during chazaros
hashataz, it would be better to learn
rather than simply daydream.
I'm not saying that one has to agree
with that approach. I'm not suggesting
disagreement either way. I'm only
pointing out that there are legitimate
opinions on this matter, so pushing one
opinion can be dangerous.
Absolutely not. It's not dangerous. I'm
just saying over what the Mishna Berurah
says.
He has a heter from his rav. Good for
him.
I go with the Mishna Berurah in
everything from A to Z and I think
everybody should
most likely go with the Mishna Berurah.
Most Klal Yisrael goes with the Mishna
Berurah from A to Z. There are some that
go with Orach Chaim still.
But, it's widely regarded by the
Chassidim, by the Litvaks, by everybody.
Mishna Berurah, Chofetz Chaim.
I'm saying what the Chofetz Chaim says.
And I'm going to keep on saying what the
Chofetz Chaim says. And if you have a
rav, Gershy, that says it's machlokes on
the Chofetz Chaim,
zol zein gezunt. But, I'm going to keep
on pushing the Chofetz Chaim.
And I think the the danger the danger is
when you start finding heter for certain
things, to me that's dangerous. Because
then everything has a heter and
everything has a heter. So, I completely
disagree with that point.
We'll go to the next thing.
Now, yeah, if somebody wants to learn
and and and thinks he could learn and
and he has a thing, let him go with his
rav. But, I'm going to say the Mishna
Berurah there's nothing wrong with
saying over from the Chofetz Chaim,
pushing the Chofetz Chaim. Great. Next.
But, it gets better, this email.
What I really wanted to raise though
relates to the sugias we just learned of
treifos and the upcoming
sugia of chodesh. In my humble opinion,
these areas may be going a bit too far
and I want to explain what I mean. It
some sometimes feels that the strong
emphasis on chodesh is not only coming
from the halacha itself, but also from a
very personal place, perhaps connected
to that past experience in the pizza
store and the mesorah from Reb Eli's
father was makpid on it. And of course,
that has great value.
At the same time, we all have fathers,
rabbonim, and mesorahs. Each person is
guided by their own rav. To present
something in a way that can be perceived
as absolute, like it's a chiyuv doraisa
for everyone, can create a very
difficult and slippery situation.
This is
where I have to disagree with Reb Gershy
Rose. Why?
Because
he's not the only one that's making this
very big mistake. Many many people make
this mistake and all the most of the
people I spoke to in the airport made
this mistake.
I asked them, "What is chodesh? What
does chodesh mean?"
The problem is that people Klal Yisrael
doesn't even know what it is. They don't
realize where it comes from.
Is it a a chumra from the Mishna
Berurah?
Who thinks Who thinks chodesh is a
chumra in the Mishna Berurah? In the
Shulchan Aruch?
Who thinks that it's a it's a pasuk in
the Torah? Anybody thinks it's a pasuk
in the Torah? Chodesh, yashan.
Nobody's raising their hand. Let me
finish that noise.
Oh.
Chodesh and yashan is a pasuk in the
Torah.
This is not a discussion of a rebbe, my
rebbe, your rebbe, my father, your
father had a trauma, I didn't have a
trauma. Yeah, I had a trauma when I was
a kid.
And the trauma was created because
there's a certain amharatzus when it
comes to this halacha, like many other
halachas.
People don't realize it's a pasuk in the
Torah. It's an explicit pasuk in the
Torah that you're not allowed to eat
chodesh. Now,
can you eat chodesh bizman hazeh?
What's chodesh? Chodesh means the new
crop of wheat before Pesach.
Pesach comes the second day of Pesach.
That's today's sugia.
Then it changes.

different legitimate approaches exist.

approaches.

beyond everything. They go to mikvah
every day. And
So why when it comes to d'Oraisa like
this, they're not makpid?
So the the answer could be that in
Europe it was very very difficult to
find yashan.
And they had a concern of pikuach
nefesh, I heard, back in the day. But
that heter rolled over into America and
into places where it was not an issue at
all.
So
I'm just putting out the information
there. You do whatever you want with it.

If you're allowed to l'chatchilah
mid'oraisa to eat in the morning from
the nates, Rebbe Yochanan ben Zakkai
wouldn't make a whole gezeirah
so that people should do it the best way
possible and get extra mitzvah.
Omer Rebbe Nachman bar Yitzchak. Rebbe

charvei Rebbe Yochanan ben Zakkai

Rebbe Yochanan ben Zakkai made a takanah

is ossur.
Omer Rebbe Yehudah "V'al omer min
ha'Torah ossur." And what did Rebbe
Yehudah say in the Mishnah?

In the Mishnah Rebbe Yochanan ben Zakkai
says "I'm making a takanah
that people shouldn't eat on the 16th
day of Nissan when there's no base
hamikdash." So what did Rebbe Yehudah
tell him? "You don't have to make a
takanah. It's in the Torah."
Meaning you don't hold this in the
Torah. I hold this in the Torah. That's
why I'm asking you a question. Why are
you telling me you're making a takanah?
It's in the Torah.
Omer Rebbe Yehudah "V'al omer min
ha'Torah ossur ad itzumo shel yom zeh."
So you see
that according to Rebbe Yochanan it's
not d'oraisa, it's d'rabbanan. Why are
you telling me that he agrees with Rebbe
Yehudah?
He doesn't agree with Rebbe Yehudah.
It's d'rabbanan. Says the Gemara "Rebbe
Yehudah deka ta'i no." Rebbe Yehudah
made a mistake. Now Rebbe Yochanan ben
Zakkai does hold it's d'oraisa. What
Rebbe Yehudah says is out of a mistake.
That's why he said it. "Whosoever Rebbe
Yochanan ben Zakkai d'rabbanan." He

held that you're not allowed to eat the

Tov. But we do it two-day Yom Tov. What
does a two-day Yom Tov mean? Because of
the safek. Because
until people in chutz la'aretz heard

could do a month could be either 30 31
days.

Maybe it was a 31-day month. So the
first day of Yom Tov is not on the 15th,
on the 16th.
So they were makpid and they for the

This this idea of doing two-day Yom Tov.

day on a day that we don't know like oh,

uh the first day of Chol HaMoed. No.

the Shulchan Aruch paskens.

this sugiyah that either it's issur
d'oraisa to eat chadash b'zman hazeh
or it's issur d'rabbanan.

The Gamara has thus presented a dispute
as to whether kholish is prohibited
outside of Israel under biblical or

Tur, and Shulchan Aruch.

came, Klal Yisrael was allowed to eat
from the new crop. So, we kind of let it
slide a little bit. So, no So, for the
Beit Hamikdash, it's not ready. But if
you brought it, we'll we'll we'll let it
slide this time.
You hear what he's saying? U'chud
m'klali.
The Omer allowed Klal Yisrael to eat it.
So, may that's it's it's
b'di'avad it'll be okay for the Beit
Hamikdash. You shouldn't, but if you did
it, we'll we'll say it's okay cuz cuz
the rest of Klal Yisrael is eating this
