Day #146–Rambam DAILY Sefer HaMitzvos

is day number 146 of our daily study of rambam sevironment and in the three chapters a day of missionary we are still in the laws of the sabbatical year specifically halachas or chapters 9 10 and 11 of those halachas our midst was today corresponding to this subject of shmito or the sabbatical year positive commandment 138. remember I mentioned yesterday that a few things happened on the joyful year that are the same ishmita basically the agricultural prohibitions but then there are other aspects of Yeovil that are unique to Yeovil now we mentioned one of those yesterday do you remember what it was that's right Liberty Bell that's your mnemonic to remember the emancipation of Hebrew slaves that's right um but here's some other stuff that happens in the ivel positive commandment 138 the return of hereditary property during the joyville year you know that the land of Israel is apportioned according to the tribes those are inherited lands so if somebody sold his hereditary property uh that is not a permanent sale it reverts it reverts after the uival or in the uh Yeovil this Mitzvah applies specifically to real estate that is not inside a walled City in the in ancient days cities where generally walled for protection so this is talking about something that's outside of a walled city of course it applies only in the land of Israel where land is inherited by the tribes also it only applies when all of the tribes are settled in the land in their ancestral portion of the land negative commandment 227 is the prohibition against selling land for perpetuity in other words you can't sell land forever it has to conform to the previous myths for the positive Mitzvah of the land reverting to its hereditary owners positive commandment 139 remember we said that this Mitzvah that we spoke about about the land reverting was land outside of Walled cities okay now we're going to talk about land inside of the walled cities positive commandment 139 this is the midst of redeeming property in Walled cities um if there is property in a walled City and a walled city is defined as a city that had a wall in the times of Yeshua bin none Joshua the successor of Moses so those properties can be redeemed meaning repurchased by the seller for an entire year following the sale he has an entire year following the sale to buy back his uh property and if the seller did not redeem the property during that first year then the sold property will be permanently owned by the buyer and it will not revert to the seller during the evil Jubilee year that Mitzvah of the property reverting to the ancestral or hereditary owner is only land outside of the Cities I guess it's sort of like the land that you work agricultural land rural land that remains within a family but a city is a Cosmopolitan place and it property changes hands sort of you know that's the way the world works today as well you know you might meet a farmer who is great great great great grandfather farmed that land and uh in a city you could find a condo that had the pen owners in the past 25 years right okay at any rate we have something very exciting coming up we're gonna finish tomorrow God willing the laws of shemitah and the entire safer Israel the book of seeds which is all about agricultural Mitzvahs so get ready for that get excited we'll see you tomorrow God willing
