Good morning boys.
Yesterday we learned the Sugya of
Yevamos.
So typical typical fashion Yevamos
doilem ran away.
We have half doilem here today.
We're getting out of it. Don't worry
about it. Here's a picture of me on the
plane tonight on the way to Miami for
Shabbos.
This Yitzy Grossberg is already going to
Miami to prepare for the Siyum right
now. The tzaddik sitting next to me that
took the picture didn't realize the
the significance of getting you in the
picture along with the Gemara. But if
you look carefully at the reflection in
the window, you can see the shear on my
phone. Of course I will not be in Miami
for the Siyum. I'll be in RBS when
you're in Miami. Looking forward to
seeing you in the two in two weeks.
Hopefully you're still in RBS when I
call.
Pastor
Lyman's Shabbos by Kesher Nafshi.
The Talmud says Yuma. Yitzy Grossberg.
Good morning Rebbi. It's been well over
a year since I've begun watching. It's
constantly gotten better and better.
So this is an email that
I'm working on my on my guy here. I
wouldn't read it if I was momish on the
top of my game.
Thanks for always trying to improve it
as well as to all those that assist in
that whether they want to be stay
anonymous or not. You know, they've
become a household name in my house for
the past year when my kids pointed out
on their own that they recognize the
bull holes in the casinos in Jersey
smooth like a baby's cheek. At least it
means that you haven't aged much in
almost 10 years. I've watched you for so
long that I've even noticed changes in
your preparation and delivery as well as
subtle changes like recently when
starting a new mission you started to
call it Zuk Tehei Mishna and not just
simply the official Mishna. I always
used to say Zuk Tehei Mishna.
Just
official ruined it a little bit but you
were going back to Okay.
I'm getting better. You see I'm getting
better. Everybody getting better. It's
not a guy that says oh you're the
greatest. I'm getting better. Yeah,
everybody is allowed to improve, no?
I still would love to come down to Miami
if I can find someone to join me and
find accommodations. All the best and
keep on going. Moishe F.
Here is Reb Joey Newcomb.
Here we go.
I need the a wire Rebbi. Hey Rebbi, what
are you going to say? Rebbi I'm staying.
Rebbi I'm
every time I see the from the shear
doilem just makes me want to sing.
The shaila is when is Joey joining us?
Huh?
I'm calling him out. Joey you need to
join the I know you're
my cashier and the whole thing in the
Yeshiva by my tired haver of Groner but
no, you got to do the all souls.
Reb boys I the Siyum are starting to
come in. Here we got in Manchester.
Please join us for the Y Manchester
Siyum
Thursday.
Only $10 a person. Beer, cholent, kugel.
Ah,
how much is that?
It's $11 says
the tzaddik from Eliyahu from
Manchester.
Ari Tyberg, I'll be in Israel
mid-January. When is the last shift in
Beit Shemesh before the Miami Siyum? So
I personally am leaving
January 24th.
The Siyum in Miami is the 25th. So be
the Siyum will be a shear
that morning. The Siyum is on the 25th.
What did I say?
Oh.
The Siyum will be here Monday but I'm
saying in terms of the shear he wants to
know if he if I'll be here that the
morning of the 24th. I'll be here the
morning of the 24th. The shaila is when
am I when am I getting back? The trip
gets keeps getting extended and
extended. It seems like I'm going from
Miami
to Colorado
to Los Angeles.
After snowboarding, yeah. After.
But in Los Angeles to be there for
Shabbos with my son Akiva.
So that's already another Shabbos. So
one Shabbos in Miami, one Shabbos in Los
Angeles. Because we're going from side
to side.
Huh?
No, man. Huh?
Maybe. We'll see.
Might have to stay in America for a few
months till the next Siyum.
All right. Reb boys I in Ors who's
mayfer with her father
died.
What about the Siyum here?
When's the Siyum here in RBS?
Tuesday
night?
I'll be here. I'll be able to be here
right before my flight. On Lachish in
that hall on Lachish.
Sign up. It's only 250 shekel a person
but we'll give you a big discount if you
sign up today.
An Ors who's mayfer with her father
died.
You have Ors
and
a father. But the
the the guy the Ors dies. And what
happens when he dies? She falls to
Yibum. They weren't mayfer. They could
be mayfer. According to Reb Akiva RA,
Reb Akiva
the Yavam can't be mayfer, right?
We had the whole Mishna yesterday. The
Yavam can't be mayfer. So the question
is could the father be mayfer now? Now
that you don't have a Yavam
and you don't have Ors. Before it was a
partnership. Father
and husband. Husband dies. A new sort of
husband falls into place called the
Yavam.
But he Reb Akiva says he doesn't count.
We don't look at him. He can't do
halacha What about the father? Could the
father himself do halacha? Another
shaila now we're going to at the end of
today's daf we're going to talk about
mikvah a lot.
So there's a famous shaila when does a
person become tahor?
When he goes into the mikvah and dunks
or when he comes out of the mikvah?
And maybe we could see a raya from our
Gemara one way or another.
So yesterday uh
the Kolel is sponsored by anonymous from
Lakewood.
The Kolel bonus is a bonus given by the
Gordon family as a bonus on top of the
Kolel guy's check.
The learning
Reb Gordon gave I don't know if he wants
to say but I'll say anyways. There's no
anonymous in MDY. He gave $1,000 to the
Kolel.
The learning on
two Batevus January should be for
Yerachmiel alav hashalom ben Yisrael
sheyichyeh.
If you weren't part of the shear then
uh it was during COVID when Yerachmiel
was very sick
with a brain tumor in the hospital
and we didn't know who this person was.
He used to come on Zoom every single day
for months and we couldn't figure it
out. It said Chop. Chop stands for
Children's Hospital of of Pittsburgh. Of
Philadelphia. Sorry. Philadelphia. And
we didn't know. It said Chop. It said
Chop. And every day we'd say "New Chop,
show your face. Chop." Nothing.
Turns out that he's he's a young man
from Lakewood stuck in the hospital cuz
they locked the doors. They didn't want
people cuz of COVID and the whole I see
Benny you're not even familiar with the
story. So I'll tell you the story. And
the they locked they said either in or
out. You can choose. But if you want to
stay with your son you can never you
can't go out. You can't come back. So he
chose to stay there for months with his
kid during COVID.
Meanwhile his family and I forgot how
many kids he had. And then MDY haver
started sending these kids gifts. And
the kid once blurted out he wished he
could go on a on a kayak. The next day a
15-foot green kayak showed up in their
house. Kids say things like that and
they bought them a computer and they set
them up with internet so they could talk
to each other from the hospital back to
the desk. And one of the most emotional
things was when Yerachmiel alav hashalom
was nifter that day
uh it was a very emotional time and then
people went to be menachem avel and
that's when Shlomi Klein went to be
menachem avel. The whole thing. But for
me one of the most emotional times in my
life was by the Siyum on Seder Pesachim
the father
um Reb Yisrael
presented me the pillowcase a MDY
pillowcase that somebody sent him as a
gift to the hospital and Yerachmiel
slept on that pillow. And he said I want
to give it to you for the for the leil
haSeder. I momish broke down crying and
I had the pillow with me
in the in the hotel. And I went from
table to table. I just made sure that
everybody I wasn't happy until they
started crying. Sit over the story. Show
them the pillowcase that the kid
eight-year-old kid was nifter and here's
the pillow. It was a nerve racking.
Okay. Anyway, so today is his yahrtzeit.
Bringing back the memories and he
donated a nice amount to the Kolel so he
should have he himself is a Kolel guy.
So
the mesechta in Sgula Torah and Yaakov

refuah for Chaim Tzvi ben Leah.
Reb Yid we have a shear right over here.
This is the is the guest place right
over here. Come. Come. Come on in.
What was going on?
You'll you'll you'll sit and you'll
stand. We'll let you stand also. Just
forget. What's your name tzaddik?
What's your name?
Sam from where?
Oh oh Sam. I know you. Yeah yeah avada.
Okay.
Who?
Ah. Where is he? How come he's not here?
It wasn't Yeah, but they were they were
here. Your grandson was here once, no?
No, the player.
So where is he? Where's Reb Wasser?
As a Reb Mannu you're not going to
you're not going to sit next to Okay,
fine. Whatever you want.
All right. So Reb boys I
we finished the amud yesterday.
All the way to the last word, my.
But because it's Nadarim and we have
pretty short dafim,
so I would like to do a quick hazara.
I'm going to fly through it. You don't
have to really understand what I'm
talking about. Just hold on for the
ride.
Basically, it goes like this.
If you see the chart, we had
a case where
you have three brothers, Reuben, Shimon,
and Yehuda.
Button.
Ah, good.
And Reuben goes bye-bye.
So what happens is that his wife,
Rachel, she falls yibbum
to one of the two brothers. There's a
zika, there's a bond between the two.
She's a shomeres yibbum to two yevamim.
Shomeres yibbum just means that
nishtanei nishtaneh her.
There's no chalitzah performed, no
yibbum performed. She's waiting. She's
in the wings. There's a zika to the two.
So says Rebbe Eliezer in the Mishnah
that one of the brothers, either Shimon
or Yehuda,
could be meifer her neder.
She has a neder, he can be meifer. Huge
chiddush. The Gemara explains no, it's
not as simple as you think. It's talking
about that one of the brothers performed
the ma'amar.
One of the two. And that particular
brother, he's the one that could do
the hafara. What does ma'amar mean?
Ma'amar means he gave her a ring. He
gave her money for kiddushin. So yes,
the Torah doesn't talk about that, or
maybe it does according to one shita,
but it's
the It makes the bond a lot stronger and
therefore
maybe she's noider on his das.
It is in in conjunction with perhaps
the fact that he has to give her mezonos
together with the father. Great. So I'm
just going to start reading here very
quickly from Tanna D'vei Eliyahu. Cuz in
order to understand what this last word
is in the next little part of the sugia,
we're going to be done. By the Mishnah,
we're going to be finished with Yevamos.
Let's just read this real quickly. It's
7:31 now. Let's see how fast we can do
it until the bottom of the almond.
Tanya nami hachi. 2 4 6 8 10
11 lines from Ein Daled Amud Beis from
the top. Tanya nami hachi. Keirabani.
I have a raya to Rebbe Ami that says
Rebbe Ami says that we're talking about
a case with this ma'amar. You see, one
of the
brothers performed ma'amar of kiddushin.
It says like this, shomeres yibbum bein
yavam echad ubein shnei yevamim. Whether
it's this like our Mishnah. Whether
there's two brothers or one brother.
Rebbe Eliezer meyafer Rebbe Shmuel echad
ubein shnayim. Rebbe Eliezer says even
one out of two brothers tremendous
chiddush he could do hafara. Rebbe
Shmuel says no, only if there's one
brother cuz then the connection is
solid. Two brothers, we don't know and
ein breira, you don't know who the real
husband is even if we find out later who
the real husband is, he can't
retroactive decide who it is. Rebbe
Akiva echad ubein shnayim. It doesn't
matter even if you have one brother,
that one brother cannot perform
hafara because he's not as strong as a
husband, as a oris. Omer Rebbe Eliezer
Umai misho she'ein lo chelek. Now this
is the what we want to bring the raya
right here. Umai misho she'ein lo chelek
bo acharei tovelei reshusai. A wife. You
have zero to do with your wife until you
perform erusin, until you give her a
ring. Misho basrei reshusai nigmerah lo.
And once you do erusin, nigmerah lo,
she's finished to him. In other words,
he could do hafara.
Isha now yevama, she esh lo chelek
acharei tovelei reshusai. Oh, here's our
raya. Let's look at these words very
carefully. We're going to go back to
these words. Isha she esh lo chelek ad
shelo tovelei reshusai. A yevama who has
something to do with her before she
comes into his reshus.
What does that mean before she comes
into his reshus? His brother died.
Like in this case, Reuben is bye-bye.
Now she has something to do with him
even though she's not in his possession.
She's not in his reshus. Misho basrei
reshusai ein lo din shetigmerah lo.
So the Gemara understands over here that
misho basrei reshusai means she came
into his reshus how? Through ma'amar.
So this is a raya that we're talking
about ma'amar.
Because it's two two stages the Gemara
says here. She We're talking about a
yevama. No question that her husband
died. Stage one is lo tovelei reshusai.
She's not in his reshus. Stage two is
tovelei reshusai.
Now if she's completely married to him,
there's yibbum, then what is she? She's
a 100% wife. And a wife, a husband could
be meifer neder. So we're not talking
about a wife. We're talking about a
woman who has a who came into the reshus
of the yavam
whereas before she wasn't in the reshus
of the yavam.
How's that possible?
If her if her husband, original husband
dies, so she what is she? She's not in
his reshus. So what happened that she is
in his reshus? If he was meyabem her, he
performed yibbum, so she's a regular
wife. If she if he wasn't meyabem her,
so she's still not in his reshus. So
what does it mean she was not in his
reshus and today she is in his reshus?
The only explanation I could come up
with is he performed ma'amar, something
in between.
No. So then what what is it? A very good
zika. What does it mean shelo tovelei
reshusai? Explain to me these words.
Isha she esh lo chelek. He has something
to do with her ad shelo tovelei
reshusai. The zika. The right? So why
does it say shelo tovelei reshusai?
She's not What?
Right. Before ma'amar. Exactly. Exactly.
The zika before ma'amar is called shelo
tovelei reshusai. Zika together with
ma'amar is called misho basrei reshusai.
So we see that we're talking about a
case of ma'amar. Rebbe Ami is mechadesh
that we're talking about ma'amar.
Ma'amar is a very rare thing. Well, in
our days it's pasul if you want to be
meyabem and we're not meyabem today, but
let's say you want to be meyabem.
We spoke about it in Yevamos. You should
do ma'amar because it's it's more
appropriate. Fine.
But
it's a chiddush that we're talking about
ma'amar. Not everybody holds like Rebbe
Ami. So but where where do we see that
we're talking about ma'amar? Because of
this lashon here. Ashrei tovelei
reshusai, misho basrei reshusai. And
then you go to the Gemara. Omer Rebbe
Akiva and Rebbe Akiva said lie. Not
true. Ima mai tovelei isha she'ein lo
chelek shelo she'ein lo chelek bo kach
ein acherim chelek bo.
Wait a minute. When you are performing
kiddushin on a woman, so beforehand once
you perform kiddushin, nobody could come
and ruin your kiddushin.
She could be mezana and then you chayev
to give her a get, but it doesn't ruin
your kiddushin. Tanya Rebbe Isha she ein
lo chelek shelo but this yevama that
Hakadosh Baruch Hu gave her to the
yavam, she she ain't she esh lo
kach ein acherim chelek bo. If there's
another brother, any brother could go
and be meyabem her, give her a get, and
ruin it for for the other one.
So don't bring a raya from anything.
Omer Rebbe Shmuel. So this Rebbe tells
him, Akiva shnei yevamim. That's great
when there's two yevamim one can ruin
for the other. Matan shevi'i yavam echad
ubein shnayim. If there's only one
yavam, like I say, I Rebbe Shmuel hold
that there's a difference between one
yavam and two yevamim. I Rebbe Shmuel
hold that if there's one yavam, he does
have the ability to be meifer neder.
Omer Rebbe Akiva echad ubein shnayim
basrei yevamim bein shlosha ubein
shnayim she'esh lo ma'amar. Says Rebbe
Akiva, I'll bring you a raya from
another case which we're going to see in
a second what it is.
There's no difference between one yavam
two yevamim.
Ukashai dvarim kein nedarim. Just like
by this other case.
This is We're going to say it's talking
about misa.
There's no difference
between yavam one yavam and two yevamim.
Ma'amar and no ma'amar. There's no
chiyuv misa.
If somebody goes ahead and marries her,
there's no misa.
There's no skila.
So too, you cannot compare yibbum to
regular marriage when it comes to be
meifer neder. Regular marriage, a
husband could be meifer neder. And
yibbum, he can't be meifer neder. Again,
regular marriage, if the wife is mezana,
there's misa.
By yibbum, there's no misa. There's a
zika. That zika is not strong enough to
create a chiyuv misa.
Balashon hazeh. Omer ben Azai. So ben
Azai said about himself, chaval lecha
ben Azai shelo shimash es Rebbe Akiva.
Look how strong he is. Look how
beautiful it is. He says such beautiful
svaros. He he destroyed us.
He got us good. Chaval, I wasn't
meshamesh him.
I would have gained that much more. Now
says the Gemara, 6 minutes. Okay, let's
go die.
Mai ta'ama d'Rebbe Akiva d'Rebbe Ami? So
where do you see from this whole thing
that we just said like Rebbe Ami? I
already told it to you.
D'ktani bein shlosha ubein shnayim ubein
shlosha ubein shnayim.
Because Rebbe Akiva, another pshat.
Rebbe Akiva when he answers Rebbe
Eliezer, he says there's no difference
if he made ma'amar or no ma'amar. So in
other words, he's addressing the ma'amar
issue. You Rebbe Eliezer think that's
talking about the case that he did
ma'amar and I'm telling you Rebbe Akiva
says no difference ma'amar no ma'amar.
Even if he did ma'amar, still he doesn't
have power to be meifer neder.
Inami, another pshat. Mireisha. From the
first part of that braisa. D'ktani misho
nichnas l'reshusai nigmerah lo.
Once she goes into his reshus, it's
over. V'ein lo kiddushin umein nigmerah
lo.
Pshat minei b'shas kishas ubein shnayim.
So it goes on this part that I was
referring to. The Ram points out, you
just have to continue going. Misho
basrei reshusai nigmerah lo. Isha she
esh lo chelek ad shelo tovelei. You have
to continue talking here.
The Gemara just brings the first part,
but it means the second part. The isha
she esh lo chelek ad shelo tovelei
reshusai. That when it comes to yibbum,
there's a stage which called not in the
in the yavam's reshus, then there's a
stage called in the yavam's reshus
before he actually marries her. What is
that? Must be
kishas
ubein shnayim. We're talking about a
case where he performed ma'amar. Okay,
end of that. Done.
Now the Gamorah just goes back into
Rebbi Akiva. My Ukhshar Dvorim Kein
Nedorim Diktonim.
Again, you see the Gamorah talks in
hints over here.
The whole thing is hints. You have to
know a little bit more.
What did Rebbi Akiva tell Rebbi Eliezer?
There's another case where you see a
tremendous difference between a Yevamah
and a a Yavum and a husband. So too,
when it comes to Nedorim there's a huge
difference between a Yavum and a
husband. A husband could be Maifer his
wife Nedorim and a Yavum can't.
Omer Rebbi Akiva Tani this is what he
meant. Ee Atmu'do She'chayav Miskeelah
Kein Na'arah Me'urasah. By Na'arah
Me'urasah when she's engaged in real
life somebody's Mizaneh with her,
there's a Chiyuv Skilah.
But not by a Yevamah. Just because she
has a bond to her Yavum doesn't make her
Chiyuv Skilah.
So
even though this Maimer and everything
it doesn't matter. They could be Maimer,
she's not she's still not on the level
of a Na'arah Me'urasah says Rebbi Akiva.
A Na'arah Me'urasah, such a strong bond
between her and her Oris that if she's
Mizaneh she gets Skilah and the other
guy gets Skilah that that shows she's
Aishes Ish Gamur. There's a 100% Aishes
Ish.
Whereas by a Yevamah the bond is not so
strong. You can add a ring, call it
Maimer on top of a Zikah, a bond.
She's not a 100% Aishes Ish. There's no
there's no Skilah and therefore if
there's no Skilah the bond is not strong
then the husband the Yavum doesn't have
the right to be Maifer her Nedorim. Is
that because it's De'Rabbanan or not
De'Oraisa?
Exactly. Very good point. Very good
point.
You hear what he's asking?
Is it because Maimer is De'Rabbanan not
De'Oraisa? In other words, if Maimer was
De'Oraisa shouldn't it be as strong as
Eirusin? And the answer is you're
probably right.
Yes. Still with the Skilah. Why not?
Oh yeah, okay. It's
it's a it's a Misah. Misah. No, if she's
married, if Maimer is Koineh her like
Eirusin
uh
so she's Na'arah Me'urasah. If she's a
Na'arah she's a Na'arah Me'urasah.
So yeah, they they
the Rishonim talk about that. That
Inahna Nami this this according to the
Shita De'Beis Shammai like you're
saying.
According to the Shita De'Beis Shammai
that Maimer is a Kinyan Gamur De'Oraisa.
Right? We also said yesterday that even
in Beis Shammai there's some who hold
that it's not De'Oraisa. It was only
strong enough
to knock off the Tsarah the Maimer and
that's only in a De'Rabbanan case. But
let's say you hold that Beis Shammai
hold that Maimer is De'Oraisa so yes
she's going to be a full fledged Arusah
and you're Chiyuv Misah Inahna Nami.
Omer Rebbi Ashi
Masnisan Nami Deikah.
Deikah?
You could prove it from our Mishnah.
It says
even in a case when there's one Yavum
Okay, whatever. I just made it easy for
the Ilum. Fine.
Um here's the case of one Yavum. Yeah?
A brother goes bye-bye and he leaves
a wife and Almana who falls Leivum to
her brother-in-law.
So it says Ein Yevamah Gemurah Le'Ishah
Ke'Shem She'Arusah Gemurah Le'Ishah. You
see this idea that
she's not a complete wife.
This Zikah doesn't create a complete
bond. It says in the Mishnah that kind
of Lashon like we're trying to explain
in Rebbi Akiva here. That's where Rebbi
Akiva says there in the Mishnah. Ein
Yevamah Gemurah Le'Ishah Ke'Shem
She'Arusah Gemurah Le'Ishah. An Arusah
is 100%
Aishes Ish.
You can't end Skilah. You can't say the
same thing about a Yevamah and Mamila
that's why you cannot be Maifer so as I
mentioned yesterday
the Ran says therefore because you see
how strong Rebbi Akiva is. Nobody argues
with Rebbi Akiva. Not only nobody argues
with Rebbi Akiva nobody nobody had a
counter argument with Rebbi Akiva. And
Ben Azai says listen wow he's
unbelievable Chaval I didn't
I wasn't Meshamesh him. I wasn't Zocheh.
So therefore he Paskins like
Rebbi Akiva.
Now
the Ran just says I have a Safek. What
happens if
the Yavum dies?
What happens if the Yavum dies? Who's
Maifer the Nedorim now? You have a
father I'm sorry. Yeah, you have Yavum
the the the original guy dies.
Says the Ran who's Maifer the Nedorim?
He says
the father is Maifer by himself.
Why is that Lashon of Mistareikhn?
Remember Mistareikhn Al Av.
The the the the power empties out back
to the father.
But Nedorim that she was Maifer when she
was with the Yavum that he has a Safek
whether or not
who's who's Maifer? I just thought it
was an interesting Lashon. If you look
all the way at the end right before it
says Mishnah in the Ran. So you look
over there he says Le'Inyan Ma'aseh
Tzorich Iyun U'Vedikah Be'Divrei
Rishonim Tzafun U'Verochov.
To know exactly what to do here let we
have to look into the Rishonim. Okay, he
himself is a Rishon. We have to look
into the Rishonim because those who were
before like the Rambam and the Ramban
those Rishonim. Okay.
Says the heading of the Mishnah.

Fine. He's going on a little trip. This
guy Yavum. Huh? This guy Yavum that's
Right. No, on the second it says
Muforim. That's
Yeah, she's cooking in the the the the
fire thing. Okay, fine.
The point is
it's not
it's not I'll tell you there's there's a
little bit of an issue with this
drawing.
I wish I would have seen it before 3:00
in the morning.
Um
he was very sleepy. No, it's it's a
great drawing but just to point out
something the Ran says over here
that it's not a case of Me'Achshav.
He tells her when I leave
then it's starting it's going to be
Chal. In other words, he gives himself a
little bit of room. He says listen I'm
going on a trip.
Last time I went on a trip
you became off of Frum decided watching
Shiurim. I once heard a guy say that a
lot of Ba'alei Teshuvahs happened from
when the husbands leave the country for
like a month or two so the wives get
bored and they start watching Shiurim on
the Slon and they
they become more and more Frum. So this
guy says listen last time I did it you
it was a mess when I got back. So all
your Nedorim are Mufor.
But he says from the day I leave. I'm
saying this two days before I leave. I
just want to I'm anticipating I might
forget. I'm going to be busy. Telling
you now. It's not a it's not a Halacha
of Me'Achshav from this moment.
In this picture looks it's already this
moment. He's already on his way. He's
gone. He's going to Hawaii or something.
Yeah, she's watching Shiurim. You see
she's already watching. He's Mechavein.
She's already she's already watching
Shiurim in the in the left window over
there.
He's going to Miami to the sea. Um
very good. Very good. Okay. So
so if he tells her Kol Hanedorim
She'Nedorim Me'Ikan Atzu Ovoy Me'Mocham
Ploni Hareini Kayov. He wants to be
Mekayeim something that didn't happen
yet.
What's Halacha Le'Yom Maklum? Lo
Meshaleim Al Oilam. I can't be Mekayeim
today. I can't say it should be a good
Neder today.
But if he says Hareini Muforim
it should be annulled.
I'm done with these Nedorim. Rebbi
Eliezer Omer Mufor. It's good. You can
be Maifer.
I can anticipate a Neder and say if you
ever try to make a Neder it's going to
be Botel U'Mevutal from now.
Ve'Chachamim Omerim Ein Mufor you can't
do that.
Omer Rebbi Eliezer he starts proving. Im
Heifer Nedorim She'Botel Chal Isur if
she already made a Neder and he found
out about it after she made a Neder he
has the right to annul to be Maifer it.
Lo Yafeir Nedorim She'Botel Chal Isur.
So shouldn't he have the right even to
stop it from happening to begin with? If
it already is there it's Mamash Chal
Isur Neder. It's a strong thing. I could
come in and do it.
So certainly if it didn't even happen I
could stop it from happening.
Omer Lo Harei Hu Omer Ishah Yakimenu
Ve'Ishah Yafeirenu. This is the
possibility I gave yesterday but we're
learning something else from it else. We
have a Hekesh. They're saying like this.
Just the Ran sticks in a beautiful word.
You're saying a beautiful Kal Va'Chomer.
Great. I would have I would have gone
with the Kal Va'Chomer. I have I have a
problem. I have a Hekesh. A Hekesh is
stronger than a Kal Va'Chomer.
What do you do with this Pasuk? Ishah
Yakimenu Ve'Ishah Yafeirenu.
Eis She'Ba'al Chal Hokein because a Kal
Va'Chomer is more of a logic.
Humans can make Kal Va'Chomers but when
you have a Hekesh there's nothing you
can't do anything about it. It says
Ishah Yakimenu Ve'Ishah Yafeirenu. Eis
She'Ba'al Chal Hokein Ba'al Chal Hafeir.
The only time you could annul and be
Maifer a Neder is if you have the right
at the same time to be Mekayeim the
Neder.
Lo Ba'al Chal Hokein but if you have a
Neder that you cannot be Mekayeim it.
Why can't you be Mekayeim it? Because it
didn't never happen. We're talking about
two weeks before it even happened and
you cannot be Mekayeim it. Lo Ba'al Chal
Hafeir. So then you can't do Hafarah.
Since the Torah says those two words
right next to each other Yakimenu and
Yafeirenu right next to each other so
that's a Hekesh. It's in the same Pasuk
they have the same Halacha.
Says the Gamorah. Eibay Lo.
Mamis lomdishe shaila. We're going to
There's a lot of lomdishe shailas in
this mesechta.
Every mesechta, but over here you see
like straight out. E boylu L' Rabbi
Eliezer mecha cholin u'vatelin o dil
miloi cholin klal?
What happened there? When the husband
says that if you ever make an a neder in
the future,
I'm annulling it.
And that's in the future. So, what
happened? It never even started or it
was chal for a millisecond and then his
he's able to revoke it once it once it
is chal for a second.
It was chal for a millisecond
and then he came along what he said 2
weeks ago that annuls it and it's made
for it.
What's the nafka mina says the Gemara
the might nafka mina? Daf hey amud beis
sponsored by Greg Haber for brocha by
los achim and the entire family and
every worldly daf.
Everyone learning the daf and also
l'atzlacha of the members of the HBA
group and their families. Amen.
Tzigoyin the atzmis achrina b'chol dei
nidro.
Check it out.
I
I just found this something I did uh I
don't know when long time ago.
There's a nafka mina between Mayaud and
Yos Shizar.
Basically,
you guys are used to it. The guy is a
nazir. Here's the guy that says he's a
nazir. Comes another guy and says,
"V'ani I want to be like him." Over here
also, same kind of idea. The woman said,
"Harei'ni nazira."
S- Comes another guy, a copycat, and
says, "V'ani k'moisa." I want to be like
her.
Now, if it's chal for a millisecond,
so there's a place for his his thing to
be chal. He says, "V'ani k'moisa." I
want to be like her during that
millisecond.
But if it was never chal even for a
millisecond and never even started
even for a moment, then his v'ani is
nothing.
She was never in a nazir.
It's If she was in a nazir, I don't care
for how long, for 2 hours, then it was
annulled. Or
a a millionth of a second and then it
was nacha Whatever it is, but she was in
a nazir for a moment in halacha,
so then a person can say, "And I want to
be like that person."
But if it wasn't chal at all,
and that's why it's a big nafka mina.
You know, was it chal at all or not chal
at all?
Now, I just want to say nachamu.
Because us human beings are social
creatures,
everything we do is with chever. We have
to live with other people and we have to
be with people. So, we mimic each other.
We're copycats. That's why Rachman
l'tzlan for the bad also. You have
people going around shooting up in
schools and do One meshugana did it and
then it became like a minag in in
America.
So too when it comes to the virsha
b'kedusha. You see, v'ani. What do we
mean v'ani?
He saw a person becoming a nazir,
he he got a he got a chizuk. He saw it
and said, "I also want to be like that."
As I get developed, people are copycats
and it's good for the good and for the
bad. So, that's why I'm saying if
anybody you should know
I'll say it again. I said it the other
day.
If you do a good deed, whatever it is,
you do something positive
and people see it,
people will follow. I'll take something
very simple.
In a certain
uh this might bother some people. I
don't care.
If a person accepts himself not to talk
during Kaddish. Kaddish, the most chomer
thing in in in in davening to talk
during, right? Don't talk during that.
Everybody knows you're the talker, you
don't care about Kaddish. And you don't
talk during Kaddish.
So, it's not only that you're doing for
yourself good,
but all the people that you shmooze with
and all the people that see you, they
also say, "Ah, look, he did So, you make
chazak to those other people, so you get
double triple the s'char cuz we're all
copycats. That's what we are.
Don't take this personally. It's
nothing. I threw it out there. Okay.
Here in daf
daf yomi, that I said yesterday.
I said it again. I'll say I saw it on
today on on Mo Landy's status. I saw it
on his status today. I started getting
into the status thing cuz I want to see
if if Sholom Rand is going to put MDW in
his status. He doesn't.
But Mo Landy does. Come out every day
and he put cuz I spoke about him. I said
he learned meseches Megillah whatever it
was. A crazy thing.
Huh?
Yossi Weidman. He is in JFK. He takes a
picture of Mo Landy learning and it
turns out he's learning meseches
Megillah. Guys are coming to learn
meseches Megillah. A regular baal habos,
a guy, one of the guys. And then Dov
Harris tells me, "I learned the whole
meseches because of Mo Landy." I'm
serious. Dov Harris is lives in England.
Yeshivish guy from the And he because Mo
Landy, I could also do it. And the the
chulu v'chulu v'chulu. That's how it
goes. People not in a bad way, in a good
way. You see he could do it, I could
also do it. Why should I watch movies
the entire flight when I can do a whole
meseches. Okay.
I just want to hear about the nidro. E
amris cholin. Mo Landy, put that in your
status, please. Shkoyach.
Sholom Rand, put that in your status.
Yeah. E amris cholin havit t'suso. If
it's chal the neder for a moment, then
the second guy who mimicked it and
copied it, he's also a nazir now. Ah,
she's not a nazir anymore. That doesn't
matter. E amris lo cholin l'yeikem asha
sha mai. So, is it chal or not chal?
Now, the Ran brings here.
It's very interesting how this Ran
works, by the way.
Uh for this amud for instance, you have
to go all the way to ain vav amud alef
to the middle of the page, more than
middle. That's where the
The whole meseches is like that. It's
like
where most of Shas Rashi's on that amud
exactly and not And once in a while it's
a shiyach l'amud beis is one line. Over
here it's like you go
30 lines down and still part of amud
beis v'chein
Keep Okay. Fine.
So, the Ran says over here
that
you have a piece of meat that's shlamim
and it's after z'rika. So,
what's the halacha of that piece of
meat?
You already did all the avoda in the
Beis Hamikdash on a piece of kotzei
chalom
and it's after z'rika. Everybody can eat
it. Yisrael could eat it. And somebody
comes along and says, "We had this sugia
already." So, the locha says, "I want my
meat This piece of meat should be like
this piece of shlamim." What did he
mean? Did he mean now right now? Right
now it's a regular piece of meat that
everybody can eat. Or did he mean 25
minutes ago when it was assur? So, what
do we say? He's matir b'isur like now.
Right now. What's right now? It's mutar
to eat. He didn't mean as the Ran.
So, by this lady also, he said, "I want
to be like her." But she right now is
mutar. She's not a nazir anymore. She
was a nazir for a second. She's like a
piece of She's like shlamim 5 minutes
ago. Shlamim 5 minutes ago is assur. We
say, "No. He's not matir b'isur on what
5 minutes ago. He's matir b'isur right
now." So, how come now in this case
So, the Ran says no because over there
he said, "K'zeh the the zeh k'zeh." This
piece of meat should be like this. Over
here he said, "Harei'ni nazir k'moisa."
I want to be a nazir like she is.
So, we understand what he's talking
about. He meant I want to be a nazir
like she was a nazir 5 minutes ago.
When he s- Cuz k'zeh k'zeh he didn't say
k'zeh sh- yesh shlamim k'zeh. He says,
"This piece of meat should be like
this." If the guy said, "I want to be
like this woman," you're right. He
didn't say "I want to be like this
woman." Like the loshon of the meat. Zeh
k'zeh. He added,
"Harei'ni nazir k'moisa."
No, like her. Like she No, it doesn't
have to do with her. Has everything to
do with her. But he was masbir what he
wants to do. He was masbir the state of
nazirus that she had, not the state of
of non-nazirus.
Now, this I got this
uh Menachem said this Finally I got a
a cartoon from this guy.
Here is Harei'ni nazir. And one guy says
gamani. The next guy goes gamani gamani.
They're all matir. They're all holding
on to each other.
But this is very good for the next
question of the Ran. The Ran says that
the halacha is that if the top guy is
mutar, you matir him, then they all
fall.
Any guy that's mutar that you do hatara
to,
then the rest below him go bye-bye.
They're all holding on to each other.
I'm like him, I'm like him. So, if you
get rid of the top guy, he goes to the
Rav and says, "I want to be matir my
neder." So, they all fall.
So, how come over here
when the husband was meifer,
the the guy, the nazir that says, "I
want to be like her," he doesn't fall.
He's He's like her. So, if she fell, so
he should also fall.
The answer is poshut.
In this case, when they all fall cuz
they did hataras nedarim. What's the
hataras nedarim?
Like Zamosc Rebbe said, it's a
retroactive. Everything from day one
goes bye-bye. So, they all fall. Over
here he's doing hafara. Hafara is from
here on out. The husband only has the
right to go from here on out. So, from
here on out he's able to catch a moment
when she was a nazir. She was a nazir
for a moment and from that moment on
she's not a nazir, but she was a nazir.
When you do hatara, they would never
nazir it becomes retroactively explained
that she they were never a nazir. Okay?
Just a simple nafka mina between hatara
and hafara. Says the Gemara.
Toshma. Omer Rabbi Eliezer meivin nidrim
she'bol chal l'isur l'yofer nidrim
she'bol chal l'isur. If, right? That was
a svara in the Mishnah Kallah Chaim. If
a husband has the right to annul his
wife's nidrim even after she made them
in the salad, so certainly she should be
able
to do it when it's weaker, when it
didn't even happen. He should be able to
stop it. Shma mina. So, what do you see
from here? Lo cholin.
It wouldn't be a kallah chaimer if it's
khow a little bit and and then he is
able to annul it cuz then the both
khimer, yeah? There's no khow and a
khimer. He's saying if my wife who made
a solid nether, I couldn't do it. So too
if my my wife made a solid nether
so I can undo it. You should go out.
They're both solids. You want to say one
is solid, one is weak. The only way the
other one is weak is if it didn't
happen. If it's if it's not a nether, if
it's right before becoming a nether. So
what do you see? It didn't become a
nether because if it did become a nether
even for a moment
then it's on the same playing field as
the as a regular nether and then you
don't have a khow and a khimer.
This is the Gemara.
Miktani she ain't in buying.
Shli bow katani. Ad dine lay bow. In
other words, in English
how do you say
um
that this nether will never happen? How
do you say it's never it will never
happen? They won't it won't come. It it
won't Over here we're saying they didn't
come.
It didn't come yet. In other words, it's
going to happen soon.
So the Gemara is saying over here also.
It I'm not saying that this nether is
not going to be khow for a moment. I'm
just saying right now it didn't happen
yet.
I still have a khow and a khimer says
the run. Why?
Because he uses a loshon.
Koshkin she often daram shinola be mumam
imaim.
Dainu afar sabow.
There's a there's a there's a khisaron
to this nether. It has a mum.
It has a
So may law, I have a khow and a khimer.
Toshma.
Omer Rabi Yosi Marbin Mogum Shein Mayfer
Nidrei Atzmoi Mishin Oidar Mayfer Nidrei
Atzmoi Actually Oidar.
It says like this in the posik. Ish
Kidor Nether Lashem Oisha Ashur Lashem
Isur Nafshoi Lo Yachol Dvaroi. A person
once he makes a nether, Lo Yachol
Dvaroi, he cannot take it back. He go to
the rabbi but himself can't undo his own
nether.
But the law is
and we learned this.
Prove it to me.
I could say whatever nether I'm going to
make in the future shouldn't be khow.
How do you know that that works?
Huh?
Kol Nidrei. Very good.
Maseches Nedarim Perek Gimmel Varoish
Shelays Kaymin Nedarim Kol Shana. If a
person doesn't want his Nedarim to be
khow, Yomer Berosh Hashana VeYom Hakol
Nidrei Sheani Otzli Lidar Yeibatel. We
do Hatara Nedarim, we do Kol Nidrei.
The point is I could say today that
whatever is in the future shouldn't be
khow. What if I make a toast? It's a
toast.
If cuz if he doesn't make a toast, if he
knows that he made this Hatara Nedarim
and Kol Nidrei
then it doesn't work. If I say I know
that I made Hatara Nedarim but I want to
make a nether anyways, then it's a good
nether. The point is he he forgot. He
forgot that he was matir all his Nedarim
in the future. You could do that.
Says the Gemara.
See, listen to this khow and a khimer.
Um Marbin Mogum Shein Mayfer Nidrei
Atzmoi Mishin Oidar. A person cannot be
mayfer his own nether.
Mayfer Nidrei Atzmoi Ashur Lidar. But he
could make sure that his nether
shouldn't be khow at all. Mogum Shein
Mayfer Nidrei Atzmoi Ashur Lidar and
then she often Nidrei Ashur Lidar. So
certainly when it comes to his wife, if
I could annul a nether that already
happened, certainly you're in the khow
and a khimer. A human being, a man, he
he could stop his own Nedarim from
happening but he cannot take care of
Nedarim that he already made. So if he
could take care of a nether that his
wife already made, of course he can make
sure that her Nedarim shouldn't happen.
May law, they should have done me the
law. It's the khow and a khimer.
They're the same, him and his wife. May
law khow and a khimer. Just like by him,
he could make sure that his nether
shouldn't be khow, he does Kol Nidrei or
Hatara Nedarim. Avizu Nami Dloi Khaila.
So too he could do that for his wife.
Law. How could this be like this? No no
connection. Maybe not. Maybe you could
do it for yourself and you can't do it
for your wife.
Toshma. Omer Rabi Yosi Marbin Mikvah. So
let me just explain this real quickly. I
guess we could do this tomorrow but it's
kishmak so good over here.
Listen to this.
A mikvah
has a very interesting thing.
If you go into the mikvah
the mikvah makes you tahor.
What if you go into the mikvah
and you bring a ring with you inside
your body?
And the ring is tamei.
So you go into the mikvah.
The ring that goes into the mikvah with
you and it comes out with you remains
tamei.
Yeah?
Where is the ring?
The ring you swallowed the ring. Swallow
the ring.
Swallow the ring. So
the the body
a human body when it goes into the
mikvah, he goes in tamei, comes out
tahor.
In other words, the mikvah has the
ability to remove tumah.
The mikvah does not have the ability to
save you from tumah.
Two things. Forget about the ring for a
second. Human body.
A body without a ring. Body goes into
the mikvah tamei, comes out tahor.
But if that human body was in a mikvah
and you you toss him a rat
he becomes tamei.
So what do you see from that? That the
mikvah doesn't have the ability to save
you from tumah. It could only remove
tumah.
But when it comes to swallowing a ring,
it's the exact opposite.
I have the ability
to swallow a ring, go into the mikvah.
I could
and I come out of the mikvah, what
happens?
The ring remains tamei.
Yet if I swallow a ring that's tahor and
I walk into a room
that has a dead body in there, what
happens to the ring?
It remains tahor.
So in other words, the human body is
like a box. It could save
tumah. It could protect from tumah.
But it cannot be metair.
The exact opposite of a mikvah. Again, a
mikvah could be metair. I take something
that's tamei, put it in the mikvah,
comes out tahor. But it doesn't have the
ability to protect.
It could be metair, it can't protect.
Because if I'm in the mikvah and I and I
hold a rat, I become tamei. So it didn't
protect me.
It cannot protect, it could be metair.
A ring inside a body is the exact
opposite. I could protect the ring but I
cannot be metair ring. If I swallow a
tahor ring and walk into a a room with
oil and mace
I become tamei, the ring becomes tahor.
So what just happened? I protected the
ring.
It's like sitting in a mikvah and
holding a sheretz and not becoming
tamei. But you do become tamei in a
mikvah. The ring does not become tamei
in a room.
But if I go into a room with a tamei
ring
if I go with a tahor ring into the room
it stays tahor.
But I'm able so it protects but it's not
metair. So if I take a tamei ring and I
put it in my body
it's tamei. Tamei to mace. And I go into
a mikvah and toivel, my body becomes
tahor, the ring becomes it remains
tamei. That means I don't have the
ability to be metair. I have the ability
to protect. It's mamish the exact
opposite of a mikvah. So what do you
see? All logic flies out the window.
You can't make a khow and a khimer from
a mikvah to a human being. They work
they operate on different systems. Human
being could protect and not be metair. A
mikvah could be metair and not protect.
Yeah? Seems a little interesting.
The point is don't bring a raya to your
wife. You could protect yourself from
Nedarim. You cannot be mayfer your
Nedarim. When it comes to your wife
you could be mayfer Nedarim but you
can't protect Nedarim. Have a wonderful
day.
Wife is a different system.
