Uh we had the the minchas sochim that goes together with different korbanos. We spoke about the oil the the flour the wine. Now today all day we're going to be speaking about smicha. What's smicha for those of you who it's your first day with MDY? Smicha means to put your full body weight on the head of the animal and you say vidui. So says the Mishnah kol korbanos tzibur eim bahem smicha. There's only two exceptions to the rule. All communal korbanos do not require smicha. Chutz min a par haba al hamitzvos the sa'ir hamishtalei'ach. Par haba al hamitzvos in this context will have later par haba al hamitzvos referring to something else but Rashi over here says par haba al hamitzvos is referring to par helem davar. What's par helem davar? Par helem davar is when Beis Din the Sanhedrin make a mistake and they say that the halacha is you're allowed for instance to eat a particular type of chelev not all chelev. They said this fat of the animal is mutar when in fact it's assur and most of klal Yisrael does it. So you have to bring one bull. Par helem davar we have a a video here. So Reb Yehuda we're going to see this is the Tanna Kamma like Reb Yehuda that says par helem davar and also the sa'ir hamishtalei'ach. It's the the goat that on Yom Kippur there's two goats one gets shachted and you the blood goes into the we do zrikas dam inside and the other one gets thrown off a cliff. So sa'ir avodah zarah is very very similar to par helem davar. It's when the Sanhedrin make a mistake and they say you could do avodah zarah. So klal Yisrael goes ahead and they do avodah zarah so you bring a goat. So Reb Shimon switches the sa'ir hamishtalei'ach with the sa'ir of avodah zarah. It's a different type of goat. On that goat you have to do smicha. And we're going to see in the Gemara I don't think anybody argues that the smicha must be done by somebody that's involved that's somebody that's the owner not some representative. And that's a theme throughout smicha. You can't do smicha for your friend can't do smicha for a partner. You have to be involved. So kol korbanos hayochid tunin smicha. Every single korban of an individual requires smicha. Chutz min habechor veha'am Yesterday that don't require nesachim. These are the three they always go together, the the maaser, the firstborn, the tenth animal of the newborns, and the carbon pesach. Those do not require smicha. Ba'al somebody who inherited a carbon an olah shlamim I missed this one. This is a This is a story I wanted to tell you. Got to say it here. Yisrael Goldstein le'iluy nishmat my sister-in-law le'iluy nishmat Dina bas Yaakov le'iluy nishmat tragically passed away on chol hamoed at the young age of 43. So this is a crazy story. Temurah we all know means that if he finds let's say a better nicer animal he says, "Oh my father left over a shvacha animal. I want to give a real animal to the Beis Hamikdash." So he goes ahead and he says this one is instead of this. That's assur. That's temurah. But he could do it. Why does it take effect? Because he's the yerush. He's instead. So I saw a very interesting shailah. When the father who died was blind somebody who's blind doesn't do smicha. So now he dies. Does the son do smicha? What does the halacha say? Does the son do smicha? His father wouldn't have done smicha. Now that his father died, he could see so maybe he should do smicha. Does he take the shoes of his father? He's exactly instead of his father and his father couldn't do smicha. Or is it a new thing? No, what do you guys say? He has to do smicha. He says He has to do smicha. And if what? So now we're just going to go through the mishna what we just learned. The What's interesting about these sugiyos is that you don't really have any like tief lamdish stuff. It's it's you know more on the easy side we'll call it. Limudim Kol korbanos hatzibur eim heim smicha chutz mipar adumah kol hamitzvos. The the community they community korbanos you don't do smicha besides two. The parah adumah the sa'ir sa'ir avodah zarah. There was a shimon that was the second chief in the mishna. Reb Shimon bar Yochai says parah adumah and avodah zarah. Like the two the two aveiros that the Beis Din forgot about and they they gave the wrong psak. They made a mistake. Not forgot they made a mistake. On those two you have to do smicha. Reb Yehudah omer sa'ir avodah zarah eim heim smicha. Wrong. Only one out of the two that you said I agree with and that is the parah adumah. I don't agree with the sa'ir avodah zarah. Oh if so v'smichah tachas heim. You need two. And now that I took out one out of your two I only have one. Sa'ir hamishtale'ach. It must be the sa'ir la'azazel. You know what? Let's show it now. Why not? Here. Sa'ir la'azazel. A beautiful piece. Now which two? It can't be the one that you're saying Reb Shimon the one of avodah zarah. So I must take in another one the sa'ir la'azazel. Omer Reb Shimon valayin smicha b'vailim. The one on the right turns white. He asked me a question. Omer Reb Shimon valayin smicha ela b'vailim. Zarim u'vanim somechin bo. He says says he says uh Reb Shimon asks, "I don't understand. In order for for there to be smicha to be considered smicha the two you're considering the sa'ir of avodah zarah. That's not the owner. You need an owner. Zarim u'vanim somechin bo. So there is smicha you're saying. But it's not the smicha we're looking for. We're looking for two smichas that that are done by the owner. Not a smicha that's done for viduy. Omer Rav Zeira u'vanim miskavnim bo. It's not true. They are considered owners because they themselves get a kaparah. And now we go through a little bit of a sugiyah here. Like a 15 20 line sugiyah just to prove that Aaron gets What What is Machaber Aaron? So, we have a Machlokes. I'll just tell you the bottom line after everything. The bottom line is this Machlokes is it the Sa'ir Does all of Klal Yisrael get a Kapara from from regular Aveiros from the Sa'ir Hamishtale'ach or do they get a Kapara from or they split it? Klal Yisrael gets from the Sa'ir, but the Kohanim gets from the Par. Yeah? Is it Rebbe Yehudah says everybody Yisraelim, Levi'im, Kohanim, they all get only from one Korban, from this one that you throw off the cliff. That's That gives a Kapara for all the Aveiros, regular Aveiros. Whereas Rebbe Shimon says, no. The Yisraelim get it from the goat that that is thrown off the Azazel, but the Kohanim get a Kapara on all the Aveiros from something else, from the Par. That's the big Nafka Mina. Because we're saying what Where is the ownership here? Do they have it Who has ownership in this goat? Do the Kohanim have ownership or not? It depends if they get a Kapara or not. The Sanya We learned the Keepers Mikdash Hakodesh. So, we're talking about something called Tum'as Mikdash Hakodesh. Tum'as Mikdash Hakodesh of You might not see it or understand it from this video. It's a little different, maybe. But, the idea is that if a Kohen, let's say It could be anybody. Yisrael also. Is Tamei. Let's say he stepped on a mouse. And he knew that he stepped on a mouse, but then he forgot. And then he went into the Beis Hamikdash. So, if he went into the Azara or went into the Heichal or went into Kodesh Hakodashim he gets a Kapara from this bull. The bull on Yom Kippur that gives the Kapara. So Well Sorry. It It depends. Yisrael gets from the goat. Kohen gets from the bull. So But, he forgot about it when he went in. Yeah? He knew about it to begin with. He had an idea Ba'techilah and then he he forgot about it Ba'sof. So, the Sanya of Keepers Mikdash Hakodesh Zos Lifnei Lifnim. I thought I did something over here. Oh. Yeah. It's time to show that the words the Mikdash Hakodesh is Lifnei Lifnim is Kodesh Hakodashim. You went in there. V'es Ohel Mo'ed Zeh Heichal. So, the second part of the second line over here Ohel Mo'ed is talking about that he went in with to the Heichal Ba'tum'a. Mizbe'ach K'mashma'o. He touched the Mizbe'ach. You know, let me just show you this. What I mean. Here. Tum'as Mikdash Hakodesh of this Yoshev did. Dead mouse. He's on the Mizbe'ach. Becomes Tamei. Heichal. But, the P'shat is here. It doesn't matter where he touched the mouse. He could be he touched it outside of Beis Hamikdash also. The point is that when he went in he he he forgot. He knew for a second and he forgot. This is Kodesh Hakodashim. This is already the Aron you see on the side, the Keruvim. Okay. V'kirev Es Mikdash Hakodesh Lifnei Lifnim. Zos Ohel Mo'ed Zeh Heichal. Mizbe'ach K'mashma'o. Yichaper El Ha'azaros. Kohanim K'mashma'o. Now, let's go back to this Pasuk for a second. Here. So, does he Two Yichapers. Does the first Yichaper is talking about the Azara. V'al Kohanim is talking about Kohanim. V'al Kol Kahal Al Kol Kahala Al Kol Am Hakahal El Yisrael. For all the Yisrael. Yichaper. Oh, so this is tricky. This is tricky. Yichaper El Ha'Levi'im. Not this word, but Yichaper is Levi'im. Who Sh'kulan L'Kapara Achas. This is where it gets tricky. Not Not super tricky, but now we're talking about Who Sh'kulan Kapara Achas is referring to Sha'ar Aveiros. Other Aveiros. Not the Tum'as Mikdash We We just jumped from the Pasuk is talking about Tum'as Mikdash Hakodesh and now we're talking about Who Sh'kulan Kapara Achas that all the Aveiros not Tum'as Mikdash Hakodesh they all they all get a Kapara from one thing. So, but Tum'as Mikdash Hakodesh it everybody agrees there's no Machlokes not Rebbe Yehudah not Rebbe Shimon. We'll see here in this chart right over here that there's no Machlokes that both according to Rebbe Rebbe Yehudah and Rebbe Shimon the Yisrael gets the Kapara from the goat and the Kohanim get the Kapara from the the Par in Tum'as Mikdash Hakodesh. Just what? They have a Machlokes. I don't know if you could see here. So, if you look all the way to the left the whole Machlokes is in that circled red. And it's in Sha'ar Aveiros. In other words, Tum'as Mikdash Hakodesh we're going to split up. Yeah? What's Tum'as Mikdash Hakodesh? A person who's Tamei went into the Beis Hamikdash. It doesn't matter where the Mizbe'ach, the Heichal, the Kodesh There's a And he doesn't know about it. He still doesn't know about it. Cuz when he finds out about it he'll bring a Korban. But, until he finds out about it, it could be 10 years, we don't want something to happen to him. So, he gets a special Kapara if he's a Kohen through the bull. And if he's a Yisrael he gets a special Kapara. It's not a Kapara. It's a It's a protection until he finds out that he did it. And the Yisrael gets it from the goat, the Sa'ir La'azazel. But, when it comes to Sha'ar Aveiros so, according to Rebbe Yehudah Yisrael and Kohen are equal. They get the Kapara from the goat that flies off the mountain. According to Rebbe Shimon, no. The same way I have an Nafka Mina in Tum'as Mikdash Hakodesh that the Yisrael gets Kapara from one thing and the Kohen gets from a second thing, so too in all other Aveiros. Lashon Hara, Retzicha, whatever it is. Avodah Zara Oh. Get a Kapara The Yisrael gets Kapara from the goat. And the Kohen gets the Kapara from the bull. Now, let's see inside. Who Sh'kulan Kapara Shemishkav Rin Ba'sa'ir Hamishtale'ach Derech Rebbe Yehudah. Rebbe Yehudah says like on top of this chart by Sha'ar Aveiros there's one Kapara for everybody. Kohanim There's no no discrimination. Kohanim, Yisraelim get the same Kapara from the same animal. Rebbe Shimon Omer K'sheim She'dam Sa'ir Hanazel Lifnei Lifnim Mechaber Yisrael Al Tum'as Mikdash Hakodesh. Just like you made an Nafka Mina when it comes to Tum'a that the Kohen gets a Kapara from a bull and the Yisrael gets a Kapara from a goat. Oh. K'sheim She'viduy Sa'ir Mishtale'ach Mechaber Yisrael Ba'sha'ar Aveiros. So, too the Viduy that the Kohen says by the Sa'ir La'azazel gives a Kapara for all the Aveiros. K'viduy Par. Now, I'm going to split it up also. The Kohen doesn't get the Viduy the the Kapara from the the Sa'ir La'azazel. He gets Kapara from the Par. Says Rebbe Shimon, just like by Tum'as Mikdash Hakodesh it's different the Yisrael and Kohen, so too by all Aveiros. As the Gemara Rebbe Shimon Hava Dei Who Sh'kulan. What do you mean? Everybody gets a Kapara. The last Look at the Pasuk. It says all the way at the end Yichaper. And that teaches us that everybody gets a Kapara. The Kohanim, the Yisraelim. So, says the Gemara, yeah. And Who Sh'kulan make Kapara you know? The Pasuk just tells us they get a Kapara. It doesn't say how they get a Kapara. Mikol Chad Chad B'nafsho. Everybody gets a Kapara in different ways says Rebbe Shimon. You get a Kapara with a bull. I get a Kapara with a goat. Now if So, let's just go back here for a second. So, Mimela that's what he's saying. That if I get a Kapara if a Kohen gets a Kapara with something the Kohen gets a Kapara with with a goat, so then he he's a Ba'alim in the goat. Then he could do Semicha. If he doesn't get Kapara with a goat, then he can't do Semicha with it. Now, Rebbe Yisrael we have a freebie. We have 12 lines that is just a repetition. And some people say that it's not even the Amora'im that wrote this. This is already later generations. The Rabbanan of Eretz Yisrael stuck it in. It It's just a recap of what we just learned. Rebbe Yehudah Tum'as Mikdash Hakodesh Yisrael Mechaber Ba'dam Sa'ir Hanazel Lifnei Lifnim Kohen Ba'par La'aron. Let's just keep this on the board for a second. According to Rebbe Yehudah Tum'as Mikdash Hakodesh According to everybody really. Rebbe Yehudah, Rebbe Shimon. Tum'as Mikdash Hakodesh Yisrael Mechaber Ba'dam Sa'ir Hanazel Lifnei Lifnim Kohen Ba'par La'aron. There's an Nafka Mina between how you get a Kapara for Tum'a. The the the the goat gives the Kapara to the Yisrael. The the bull gives the Kapara to Aaron. Ba'sha'ar Aveiros Mechaber Viduy Sa'ir Mishtale'ach. And Rebbe Yehudah says the only And there's only one Nafka Mina between Rebbe Shimon and Rebbe Yehudah. That in Sha'ar Aveiros Rebbe Yehudah says that everybody gets a Kapara from the goat. While Rebbe Shimon there he argues like you see in the red dotted line. Rebbe Shimon Ba'sha'ar Aveiros Navi Gad Rebbe Yehudah Par Mishtaber There's an Nafka Mina between Yisrael and a Kohen that the Yisrael gets Kapara from the goat that flies off the mountain. And according to And And the Kohanim get a Kapara from the bull. Oh. K'diktani. Eich Od Yisrael Ve'eich Od Kohanim. The what? They're They're They have a Kapara from the Azazel. Reb Shimon says K'shem she dam asur nazir b'fnim k'haval Yisrael k'dam k'haval Kohanim, just like this an af k'mina in tumah that the the tumah a coin gets kaparah from a bull and Yisrael gets kaparah from a goat. The Yisrael k'haval k'haval Kohanim. Okay. So that is the chazarah that we just did. So too he says there's an af k'mina that the all other areas the Yisrael gets a kaparah from a goat and a coin from a par rabah. There's some who say this is Marsha Par. This is referring to the par elem davar the smicha. Par ton smicha bein tzvei avodah zarah ton smicha d'Rebbi Yehudah. Yehudah says that avodah zarah goat does not require smicha. Uh bein ya. Reb Shimon par ton smicha b'skeinim bein tzvei avodah zarah ton smicha b'skeinim ela b'Aharon. So this is what you need to remember for the next 25 seconds that according to Reb Reb Shimon who does the smicha on avodah zarah goat? Aharon. Who's Aharon? The coin gadol. Brother. Shalom aleichem.
