Someone is a 1099 if they are an independent contractor. What that means is take the word independent. It means they have to be on their own. They have to set their own schedule. You cannot be telling them when to do something, how to do something, where to do something. They have to be independent. They have to have the ability to work for other people, doing other jobs, earning other money on their own because they're independent. So the example I like to give is when the air conditioning is not working in my office and I call an air conditioner repair person. That person's an independent contractor coming in to fix my air conditioner and he decides when he's going to come in.
