A recap of the Machlokes Reb Yishmael and Reb Akiva in Chulin Daf 17

Going back to the Icar portion of yesterday's Duff and that is the epic my locus between Rebbe Shmuel and Rebbe Akiva. Let's just set this up a little bit. We mentioned that there are Sukim in Parshas Re'eh. This is in Perek Yud Beis, Pasuk Chof, Chof Aleph, Chof Beis, Chof Gimel, Chof Vav, Tucked away that describe Moshe Rabbeinu telling the Yidden that when you're going to come to Eretz Yisrael, you're going to want to eat basar, it'll be okay to eat basar. Stating that you have to shecht, also make sure you don't eat the dam. You could eat it b'tuma or b'tahara. Also recognizes as only true for Chulin. As it relates to Kodshim, that already you're going to have to bring to the Makom Hamikdash and if you do that, it's a gezeirah. That's basically what Moshe Rabbeinu tells the Yidden. Now, it would seem to suggest that before the Yidden came to Eretz Yisrael, there was something in this parsha that was really off limits and there was a major machlokes Rebbe Shmuel, Rebbe Akiva what that was. Rebbe Shmuel said, "I understand reading the simplest translation of these words in these psukim that what the pasuk is saying is that until the Yidden came to Eretz Yisrael, if somebody wanted to eat meat just because he wanted a piece of meat, it would not have been okay. Basar ta'avah was assur during the 40 years that the Yidden were in the midbar. It was dafka when they came to Eretz Yisrael that it became mutar. Rebbe Akiva said that's untenable. For sure the Yidden were allowed to eat basar ta'avah when they were in the midbar. Okay, so then what's the chiddush of this pasuk? The chiddush is that when they were in the midbar, if they wanted to eat basar ta'avah, you can go hunting. But here, there's a v'shachtem tzoin v'kar. As you know, tzoin is a kashrus issue. Now already you have to conform with the laws of shechitah. So according to Rebbe Yishmael, there was an issur basar ta'avah for years in the midbar which became mutar when they came to Eretz Yisrael. According to Rebbe Akiva, there was a heter basar ne'echerah during the 40 years that the Yidden were in the midbar. And when they came to Eretz Yisrael, now all of a sudden basar ne'echerah became assur. We also saw very much in yesterday's Duff that the Gemara said that inasmuch as Rebbe Shmuel holds there was an issur basar ta'avah, but it was only with regards to basar, an animal that was able to be brought on the mizbeach. But the and the aisle for example the slob that we mentioned in the post game yesterday any animal that wasn't actually put on the mizbeach that you were allowed to eat also an issue of basar taiva. The gemara also qualified that as much as all that you allowed to eat basar that was only true as it relates to basar but basar kodeshim learn has been a mocker etc. over there there was going to be a lot of it was just as it relates to basar taiva as it relates to >> [snorts] >> here there was a lot of that you were allowed to eat basar another thing we mentioned very much yesterday was that this is has ramifications how to learn the we know there's a and then there's a this is 101 etc. And I think 100 out of 100 times a learns the of etc. He looks at the it's a in stating that the and the and the and really all the them say that in the world of for sure there's to say that that is actually not unique to there is an Indian maybe of but but the loved but because even by there was an issue of and IT COULD BE THAT EXTENDED ITSELF TO AN ISSUE OF I CAN IF SOMEBODY WOULD BASAR WOULD EVEN BE CAUGHT AND THE AND HE SAYS I PREFER THIS and he says that all the and all that are MORE LIKE AND THEREFORE IN HERE AND THE OF the goes and he's the like that it's not even dealing with because of that but rather what it's dealing with is basar what it's dealing with is an ISSUE TO BASAR TAIVA BECAUSE AND IF A PERSON would go ahead and do that HE WOULD BE CAUGHT as a We mentioned yesterday but the Rambam in the end of perek daled of Hilchos Shechita, where the Rambam learns like Rabi Akiva, halacha like Rabi Akiva mechavero, but even in Rabi Akiva's world, the Rambam learns the pasuk in Mikra in parshas Acharei Mos, the parsha of Shechitas Chulin is talking about bechulin. Because even Rabi Akiva who held that basar chulin is mutar, the issue there is that if you want to eat chulin it has to be nacher. Because the only time you're allowed to do shechita is after it got in the makom hamikdash. Either way, this is some of the rebbes spoke about yesterday, we mentioned from the Netziv, what would be the beer, the analogy of shecht basar chulin period, and that it's a chiyuv kares. The Torah Tmimah brings the pasuk that says "Velo yeechelu ois asif chayam l'seir masheh mizonei macher." That's what the pasuk says, and that is a reason maybe not only to not shecht kodshim bachutz, but not even to shecht chulin bachutz. And if this is an avizrayhu d'avodah zarah, you understand why it's something that would carry with it this harsh punishment of a chiyuv kares. Again, there's so much to be marechiv on this inyan, ki yachil basar kodesh b'chulin, but again, a very very short recap of some of the rebbes that we spoke about yesterday.
